Any not-for-profit corporation or any other organization or association
may petition the Board of Trustees to participate in the Adopt-A-Road-And-Lot
Program.
Such applicant shall complete a form setting forth the names and addresses
of all participants, either on an individual or group basis. Such application
may be obtained from the Village Clerk.
The application shall be submitted to the Village Clerk, who may forward
the application to the appropriate departments or divisions of the Village
of Johnson City for review and comment as to the feasibility and compatibility
of the organization or group participating in the cleanup and care program.
The Board of Trustees, after receipt and review of the recommendations
of the Director of Public Services and the reports of the proper departments
and divisions of the government of the Village of Johnson City, will adopt
a resolution authorizing the organization or group to begin a program of care
and maintenance of said road or lot. Thereafter, and before any work is undertaken
by the organization or group, a duly authorized representative of the organization
or group shall sign an Adopt-A-Road Agreement on a form furnished by the Village
Clerk and shall furnish all other documentation called for in that agreement.
Only after such agreement has been signed by the Mayor shall any work begin.
The application for participation in this program shall set forth what
steps and what actions the particular organization or group is going to take
to provide the continuous care and maintenance of the road from debris, trash
and refuse. At a minimum, the applicant shall agree to pick up litter and
plant flowers, shrubs or ground cover, if applicable, and maintain the same.
After a period of not less than six (6) months, the organization or
group which has petitioned the Board of Trustees shall request the appropriate
departments and divisions of this municipal government to review its action
over a six-month period, and the departments and divisions of the Village
of Johnson City shall then report their findings to the Board of Trustees.
After the governing body has received the reports of departments which have
reviewed and inspected the work efforts and after a committee, consisting
of members of said Board appointed by the Mayor, shall review the area, the
adoption of a resolution to post said road or lot as an adopted road or adopted
lot shall then be recommended to the Board of Trustess, and the Board of Trustees
shall then commend the organization or group for its efforts.
If a road or lot is adopted after the procedures have been followed
as set forth herein, an appropriate sign or signs shall be erected in a prominent
place displaying the fact that this road or lot has been adopted under this
program and is qualified as a road or lot appropriately cared for and maintained
by the adoptive group.
The organization or group which performs any work or services under
this program shall not be deemed to be an employee of the Village of Johnson
City but merely volunteers, and the Village of Johnson City shall be held
harmless from any negligent or careless acts of the organization or group
and performance of any functions under the program, and in this connection
the organization shall furnish to the Village Clerk satisfactory evidence
of liability insurance coverage, covering the group's proposed activities
and naming the Village of Johnson City thereon as an additional insured. The
applicant further agrees not to permit anyone under the age of twelve (12)
years to participate in the program.
The Village of Johnson City shall not supply any tools, equipment or
supplies for this program. Any and all tools, equipment or supplies shall
be furnished by the volunteers.
