Location. The provisions of this article shall apply
to the land located in the Township of Bethlehem known as the Chandoha
Farm, located along County Route 614 and identified as a portion of
Block 44, Lot 25, specifically the Tract 2 EIFP area consisting of
approximately 15.14 plus or minus acres (hereinafter the "Tract 2
Area"). Hunting shall be permitted on the Tract 2 Area only with strict
compliance with the permitting laws contained herein. Hunting is not
allowed and shall not interfere with any other Township owned property
other than that described above. The provisions of this chapter are
a supplement to federal and state hunting and game laws and do not
relieve an individual from complying with such laws. All hunters shall
comply with such federal and state laws except where the laws contained
herein are more restrictive, in which case a hunter shall comply with
this Code. To the extent that anything contained in this chapter is
inconsistent with such federal and state hunting and game laws, the
provisions of this chapter shall not apply.
Targeted game. Targeted game on the Tract 2 Area is
limited to such game as allowed by the New Jersey Fish and Game Code,
subject to any further restrictions as contained herein.
Season. The hunting season on the Tract 2 Area shall
be in accordance with New Jersey laws and regulations for each species
hunted. No hunting shall be allowed on any other Township property
at any other time. No hunting shall be allowed on Sundays.
A hunter shall not be on the Tract 2 Area for more
than 60 minutes prior to the legal shooting time and more than 60
minutes after the legal shooting time. A hunter may remain in the
Tract 2 Area for more than 60 minutes after the legal shooting time
in order to track a wounded animal or locate a missing person, but
must notify a park ranger by cellular phone or in person or leave
a note on his or her vehicle.
Compliance with Green Acres Regulations. The Chandoha
Farm, which includes the Tract 2 Area, is subject to the Green Acres
Regulations of the New Jersey Department of Environmental Protection,
as set forth in N.J.A.C. 7:36 et seq., as amended from time to time.
The public shall be afforded reasonable access to the Chandoha Farm
and the Tract 2 Area in accordance with the Green Acres Regulations.
Only one permit shall be granted per hunting season
to a hunting club that successfully bids for the ability to hunt the
Tract 2 Area pursuant to the Township's bid specifications which shall
be advertised by the Township from time to time, subject to the Township's
sole discretion.
Said permit will only be issued to the hunting club
upon execution of an agreement with the Township setting forth the
terms and limitations of hunting on the Tract 2 Area.
No person who has been convicted of any crime or of
a disorderly persons offense in any state or federal court shall be
permitted to hunt on the Tract 2 Area.
All hunters must carry the Township's authorization
to hunt, issued to each hunter in accordance with the hunting agreement
between the Township and the club, along with the hunter's New Jersey
hunting license.
All hunters must display a placard, issued by the
Township, on the dashboard of the hunter's parked vehicle. The Township
has the right to tow any vehicle parked on Township property that
does not display a placard.
Application process to obtain a permit for each year's
hunting season. Applications are to be made by hunting organizations
or clubs only, on behalf of their members, and made in accordance
with the requirements set forth in the Township's bid specifications.
Insurance and indemnification. The hunting club shall
maintain commercial liability insurance of at least $2,000,000 as
required under the hunting agreement. The policy shall be obtained
from a company with a rating of "A" or better, and the Township shall
be named as an additional insured and certificate holder on the policy.
The hunting club shall indemnify, defend and hold harmless the Township
from and against all claims, demands, suits and liability in accordance
with any and all hunting conducted on Township property.
No person shall engage transport, bring, dump, deposit
or leave any garbage or trash on Township property or public lands
which includes but is not limited to: bottles, broken glass, ashes,
carcasses, ammunition debris, cans, plastic debris, rubbish, waste
or any other refuse or debris. The person responsible for producing
said garbage or refuse shall remove the same from Township property
or public lands when leaving the property and shall properly dispose
of the same in accordance with state, county and municipal law and
regulations.
The Township permit holder, i.e., the hunting club,
must complete an end-of-season report of animals harvested within
the Township's hunting grounds. Failure to submit a timely report
will result in the club's inability to submit a bid for a permit to
hunt for the following year.
The hunting club's members who are authorized to hunt
on the Tract 2 Area are responsible for being aware of hunting boundaries
and obeying all posted signs.
All hunters on the Tract 2 Area are required to report
the violation of any federal or state laws on hunting and game, and/or
any violation of any provision contained herein, to New Jersey State
Police.
All hunting club members who are authorized to hunt
on the Tract 2 Area must be aware of and comply with the rules contained
herein. Any violation of these rules will result in the denial of
the club's ability to bid for a permit for the following year.
All hunting club members shall respect the rights
of adjacent property owners and others who may be using Township property
or public lands and shall take measures to ensure that said club members
do not unreasonably interfere with said adjacent property owners and
others utilizing Township property or public lands.
