This article shall be titled "A Local Law Regulating Boating on Honeoye Lake" and is to repeal the intended Local Law No. 3 of the year 1990 titled "A Local Law Regulating Boating on Honeoye Lake."
This article shall be adopted pursuant to Article 9, § 130, Subdivision 17, of the Town Law, Regulation of vessels.
This article is enacted to provide regulations for the safe operation of vessels on Honeoye Lake and to preserve the use and enjoyment thereof by boaters and residents living along the shore of the lake and in the general area of Honeoye Lake. The regulations are in addition to or supersede those contained in the New York State Navigation Law.
The word "vessel," as used in this article, shall be deemed to mean and include the same definition of "vessel" as defined in § 2 of the New York State Navigation Law.
A. 
No vessel shall be operated within 200 feet of Honeoye Lake shore, a dock, pier, raft or float or an anchored or moored vessel at a speed exceeding five miles per hour, unless such vessel is being operated within said distance of such shore, dock, pier, float, raft or anchored vessel for the purpose of enabling a person engaged in waterskiing to take off or land.
B. 
No vessel on Honeoye Lake shall be operated at a speed of more than 10 miles per hour from 1/2 hour after sunset to 1/2 hour before sunrise.
C. 
A violation of this section shall be a violation punishable as set forth in § 73-c of the New York State Navigation Law.
A. 
Between sunset and sunrise, non-mechanically-powered vessels such as rowboats, canoes and paddleboats, and also all vessels whether anchored or adrift outside of special anchorage areas, shall continuously display a white light visible from all around the horizon for a distance of at least one mile.
B. 
A violation of this section shall be a violation punishable as set forth in § 43, Subdivision 4 of the New York State Navigation Law.
Pursuant to Article 9, § 130, Subdivision 17, of the Town Law, Regulation of vessels, this article shall take effect upon adoption by the Town Board of the Town of Richmond and the Town Board of the Town of Canadice and upon filing with the Secretary of State.

This article amends and supersedes Local Law No. 1 for the year 1994 and Local Law No. 1 of the year 1998 and shall be known as the "Sandy Bottom Park Law — Local Law No. 1 of the Year 2010."
This article shall be applicable to all that land adjoining and adjacent to the north end of Honeoye Lake with boundaries going east to County Road 33 (East Lake Road), north to State Route 20A (Main Street), and west to County Road 36 (West Lake Road), and owned by the Town of Richmond, Ontario County, New York, and commonly known as "Sandy Bottom Park." The property is more particularly described in the topographical survey map filed with the Town Clerk on December 15, 1993, and in a Map of a Survey of Lands of Minnesota Mining and Manufacturing, Parcel "C" dated April 12, 1994, and approved by the Richmond Planning Board on March 27, 2003, both maps by Gary Dutton, Land Surveyor. Hereinafter, said lands shall be referred to as the "park."
As used in this article, the following terms shall have the meanings indicated:
NUISANCE SPECIES
Nuisance species are species that can cause harm to the environment, the economy or to human health.
NUISANCE WILDLIFE CONTROL LICENSE
The New York State Department of Environmental Conservation (NYSDEC) may issue a nuisance wildlife control license (NWCL) to qualified individuals to act as an agent for a property owner or lessee. The licensee is permitted to take, temporarily possess, transport, and release wildlife, at any time whenever the wildlife becomes a nuisance, destroys property, or menaces an individual or domestic animal.
TO HUNT
To pursue, shoot, kill or capture (other than trap) wildlife and includes all lesser acts that disturb or worry wildlife whether or not they result in taking. Hunting also includes all acts to assist another person in taking wildlife.
TO TAKE
To pursue, shoot, hunt, kill, capture, trap, snare or net wildlife and game and all lesser acts that disturb or worry wildlife or to place or use any net or other device commonly used to take wildlife.
TO TRAP
To take, kill or capture wildlife with traps, deadfalls and other devices commonly used to take wildlife, including the shooting or killing of lawfully trapped animals. It also includes all related activities, such as placing, setting, staking or checking traps or assisting another person with these activities.
The parklands shall be accessible each day from sunrise to sunset. The availability of pavilion, bathhouse and bathroom facilities and hours for lifeguards to be on duty shall be set by the Town of Richmond Recreation Director. The Town Board of the Town of Richmond shall reserve the right to regulate the hours of opening and closing and may, if the Board deems necessary, close the park.
A. 
The following are prohibited at all times on all lands of the park:
(1) 
Hunting, trapping, camping and glass beverage containers of any type.
B. 
The following are prohibited on all lands of the park except as noted:
(1) 
Sale, possession, and, or consumption of alcoholic beverages is prohibited anywhere in the park, except as permitted by the Town Board pursuant to §§ 85-4 and 153-17.
(2) 
Operating and/or parking of any motorized vehicle, all-terrain vehicle or snowmobile in the park except in designated areas as authorized by the Richmond Town Board or its duly authorized agent, employee and/or representative.
(3) 
Pets or domesticated animals other than dogs unless the same is confined to a motor vehicle or in a cage. Dogs are allowed in areas of the park except on the beach and around the pavilions, provided that the dogs are on a leash under the complete control of the dog's attendant or in a fenced area specifically designated for dogs.
(4) 
Horses and horseback riding shall not be allowed in any part of the park at any time except upon authorization of the Town Board.
Swimming shall be allowed in designated areas only and only at times when a lifeguard is on duty and opens the designated swim area.
A. 
No vessel as defined in § 2 of the New York State Navigation Law shall be launched or removed from park and/or Town land between June 15 and the Wednesday after Labor Day. Vessel operators shall refrain from operating in areas adjacent to the park used by swimmers.
B. 
This prohibition shall not apply to rowboats, canoes, paddleboats, kayaks and the like, which may be launched from the park over and across designated areas only. The designated launch area for rowboats, canoes, paddleboats, kayaks and the like shall be the east end of the Sandy Bottom Park Road at the cul-de-sac. Such craft shall refrain from operating in areas adjacent to the park used by swimmers.
No fires shall be permitted in the park other than for outdoor broiling in metal or masonry-grill-type cookers already provided for such purpose.
No rubbish, refuse, recyclables or returnables of any type shall be deposited or left in the park other than in containers provided for such purposes.
Any group wishing to reserve a pavilion at the park must submit an application form with applicable fee to the Town of Richmond Recreation Director. The Town Board shall set by resolution the amount of said fee and shall each year review said fee to determine if any change is required.
Problems sometimes arise when the activities of people and wildlife clash. Nuisance Wildlife Control Operators (NWCOs) are private business owners licensed by NYSDEC to handle and remove most wildlife causing issues in and around your property. NWCOs charge a fee for their services. In the event a situation develops that the activities of people in the park and wildlife clash, nuisance wildlife control may be considered. In consultation with the NYSDEC and at the sole discretion of the Richmond Town Board, a NWCO may be retained to remedy the nuisance situation.
Any person who violates this article shall be guilty of a violation and, upon conviction thereof, shall be subject to a fine of not less than $100, and not more than $500, or imprisonment for a term not to exceed 15 days, or both.
Exceptions to the foregoing rules and/or regulations may be authorized in writing by the Richmond Town Board as it from time to time may find to be in the best interest of the citizens of the Town of Richmond.
