From and after the passage of this chapter,
it shall not be lawful for any person or persons, partnership or corporation
to connect any private driveway with a Township road within the limits
of West Deer Township without first having obtained a permit for same
as hereinafter set forth and without constructing said approaches
and installing drainage pipes under said driveway approaches in accordance
with the minimum specifications hereinafter provided.
Any person or persons, partnership or corporation
desiring to connect a private driveway with any Township Road shall
first make application to the Township Manager/Secretary for a permit,
to which application there shall be attached a sketch showing the
proposed connection and drainage facilities to be provided in accordance
with the provisions of this chapter and as set forth in Township Drawing
No. 1260-1, dated December 1960.

Upon the filing of an application for a permit
as herein provided, a fee as set from time to time by resolution of
the Board of Supervisors shall be paid to the Township of West Deer
to cover the cost of inspections.
The following minimum specifications for the
construction of private driveway approaches with Township roads and
the drainage facilities thereof are herewith adopted:
A. The minimum shoulder width from the edge of the paved
or traveled portion of a Township road to the ditch line shall be
six feet.
B. Said shoulder width, commencing at the edge of paved
or traveled portion of the Township roads, shall slope down to the
ditch lines to a minimum depth at the ditch lines of three inches.
C. Drainage pipes under private driveways shall be installed
at a distance of not less than six feet from the edge of the paved
or traveled part of the Township roads.
D. The minimum diameter of drainage pipe under private
driveways shall be 12 inches, and greater, if necessary, to assure
free and unobstructed flow of all berm water.
E. The minimum width of an approach to a Township road
shall be 12 feet for a single driveway, and wider if, in the judgment
of the Township Engineer, this is required for safe egress and ingress
to and from the Township road.
F. All drainage pipes under private driveways shall be
laid parallel with the gutter line and flow of the ditch water.
G. The precise size of all drainage pipe and the depth
at which the same shall be laid shall be determined by the Township
Engineer or other duly constituted agent before installation.
H. The drainage pipe shall be of standard gauge corrugated
metal or better.
Prior to the commencement of any work or driveway
approaches, an inspection of the site shall first be made by the Township
Engineer or other duly constituted officer or agent of the Township.
The construction of all private driveway approaches
and the installation of drainage pipe shall be the responsibility
of the property owner, who shall bear the total cost of the same;
and upon completion, the materials used and the work done shall be
subject to inspection and approval by the Township.
The Township Manager/Secretary shall make available
to all applicants for permits copies of Township Drawing No. 1260-1,
dated December 1960, for information and guidance, which drawing by
reference hereto is made part hereof.

Any person, firm or corporation who shall violate
any provision of this chapter, upon conviction thereof in an action
brought before a Magisterial District Judge in the manner provided
for the enforcement of summary offenses under the Pennsylvania Rules
of Criminal Procedure, shall be sentenced to pay a fine of not more
than $1,000, plus costs, and, in default of payment of said fine and
costs, to a term of imprisonment not to exceed 90 days. Each day that
a violation of this chapter continues or each section of this chapter
which shall be found to have been violated shall constitute a separate
offense.
