This chapter shall be known and may be cited as the "Westmont Borough Grass and Weed Ordinance."

It shall be unlawful for any person owning, leasing, occupying or having a present interest in any real estate within the limits of the Borough of Westmont, County of Cambria and Commonwealth of Pennsylvania, to permit any grass or weeds or similar vegetation not edible or planted for some useful or ornamental purpose to grow or remain on such premises so as to exceed a height of 10 inches or to throw off any unpleasant or noxious odor or to conceal any filthy deposit or to create or produce pollen. All such grass, weeds or other vegetation is hereby declared to be a nuisance and detrimental to the health, safety, cleanliness, comfort and general welfare of the inhabitants of the Borough of Westmont.
It shall be the duty of any person owning, leasing, occupying or having a present interest in any real estate within the limits of the Borough of Westmont to remove, trim or cut all grass, weeds or other vegetation growing or remaining upon such premises in violation of the provisions of this chapter.

If a person shall neglect, fail or refuse to comply with this chapter within 10 days after receipt of notice as set forth hereinafter, the Borough may hire a reputable contractor to remove, trim or cut or cause to be removed, trimmed or cut such grass, weeds or other vegetation, and the cost thereof may be collected by the Borough from such person through an action before a District Magistrate.

A.
Notice by the Borough of Westmont as required by this chapter shall be given by the West Hills Regional Police Department by personal service or by United States mail to the address of the owner as reflected in the records of the Borough of Westmont. In the event of a failure to comply after 10 days' notice, unless extended for cause by the West Hills Regional Police Department, a citation shall be filed before the District Magistrate without further notice.
B.
Any further violations during the calendar year would result in an immediate citation filed with the District Magistrate without the necessity of further notice.

Any person who shall violate or fail, neglect or refuse to comply with any provisions of this chapter shall, for each and every such violation, upon conviction thereof, be sentenced to pay a fine of not more than $600 and costs of prosecution, and, in default of payment of such fine and costs, to imprisonment in the county jail for a term not exceeding 30 days, provided that each day's violation shall constitute a separate offense.
