This chapter shall be enforced by a Codes Enforcement
Officer who shall be appointed annually by the Town Board. The powers
and duties of the Codes Enforcement Officer shall be:
A. Examine and approve applications pertaining to the
use of land, buildings or structures when the applications conform
with the provisions of this chapter.
B. Issue all zoning permits and keep permanent records
thereof.
C. Conduct such inspections of buildings, structures
and uses of land as are necessary to determine compliance with the
provisions of this Zoning Chapter.
D. Receive, file and forward for appropriate action all
applications for special uses, variations and amendments to this chapter
which may be filed in the zoning office.
E. Maintain permanent and current records of this Zoning
Chapter, including all maps, amendments, special uses and variations.
F. Collect, receipt and account for all fees chargeable
under the provisions of this chapter and pay all of the same into
the Town General Fund.
A zoning permit shall be required for all lawful
nonconforming uses of land or buildings created by the adoption of
this chapter and applications for such permits shall be filed with
the Codes Enforcement Officer within one year after the effective
date of this chapter. It shall be the duty of the Codes Enforcement
Officer to issue such permits free of charge, but failure to apply
within the specified time or refusal of the Codes Enforcement Officer
to issue such permits shall be evidence that said nonconforming use
was illegal or did not lawfully exist on the effective date of this
chapter.
A fee, as set from time to time by resolution
of the Town Board, shall be chargeable and shall accompany each application
for a zoning permit. Such fee shall be paid into the General Fund
of the Town if the application is approved or returned to the applicant
if the application is denied.
