The purpose of this article is to implement
§ 1203-a of the Vehicle and Traffic Law (Chapter 838 of
the Laws of New York of 1977) by providing for the issuance and use
of parking permits for handicapped persons.
For the purposes of this article, those definitions
established as guidelines by the State Advocate for the Disabled shall
be applicable.
The Town Clerk of the Town of Williamson is
hereby designated as the agent for the issuance of special parking
permits to handicapped residents of the Town of Williamson in accordance
with the following:
A. Such permits shall be in the form and style as may
be prescribed by the Commissioner of Motor Vehicles pursuant to § 1203-a
of the Vehicle and Traffic Law of the State of New York.
B. Application for such special permits shall be on forms
prescribed for said purpose by the Commissioner of Motor Vehicles
and in accordance with the procedures and guidelines established by
the said Commissioner and the State Advocate for the Handicapped.
The issuing agent may suspend or revoke any
permit or refuse to renew any permit upon a finding that:
A. The applicant has made a material false statement
in the application; or
B. The applicant has used or permitted the use of the
permit contrary to conditions set forth in the permit and in this
article; or
C. The applicant has failed to comply with or observe
any of the conditions of the application and/or of the permit; or
D. The applicant shall have failed to have notified the
issuing agent of any change of address or disability within 10 days
after such change.
Upon denial of an application for a permit or
a renewal or upon a suspension or revocation of a permit, the applicant
may make written requests for a hearing. The issuing agent shall grant
such hearing, to be held before him, within 10 days after his receipt
of such written request. The written request must be filed with the
issuing agent no later than 30 days following notification of the
applicant of the action as to which the hearing is requested. The
issuing agent shall, in any event, notify the applicant within 21
days after receipt of the completed application as to its approval
or disapproval. If the application is disapproved, a statement setting
forth the reasons for disapproval shall be provided.
A handicapped person with a valid handicapped
parking permit, lawfully issued, shall be eligible to park in any
parking place designated for handicapped persons in the Town of Williamson
and in any area in any municipality of the state which has been designated
by such municipality as a place for parking for handicapped persons.

A. Each shopping center which has filed a written request
with the Town Board of the Town of Williamson to regulate traffic
in parking areas pursuant to § 1660-a of the Vehicle and
Traffic Law of the State of New York shall provide parking spaces
to be used solely by vehicles displaying parking permits for handicapped
persons. Such parking spaces shall be in accordance with the following
guidelines:
(1) The spaces shall be located in the general parking
area of the shopping center and shall be in close proximity to an
entrance of the stores in the shopping center.
(2) Each space shall be designated by the uniform sign
authorized for such purpose as established by the Department of Transportation
Federal Highway Administration.
(3) The "reserved for handicapped" sign shall be so affixed
as to not be portable or movable.
(4) Affixed to the sign post or adjacent to the uniform
sign there shall be a separate sign with letters of not less than
two inches and not more than three inches stating "$10 Fine for Violation."
B. Reserved parking areas.
(1) The stopping, standing or parking of any vehicle,
except for a vehicle which bears a handicapped parking permit issued
pursuant to § 1203-a of the New York State Vehicle and Traffic
Law or a registration issued under § 404-a of the New York
State Vehicle and Traffic Law and which vehicle is being used for
the transportation of a handicapped person, is prohibited in the following
areas:
(a)
On the south side of Main Street between a point
60 feet west of the intersection of the south curbline of Main Street
with the west boundary of Route 21 and a point 16 feet further west,
encompassing a diagonal parking face.
(b)
On the north side of Main Street between a point
165 feet east of the intersection of the north curbline of Main Street
with the east boundary of Route 21 and a point 16 feet further east,
encompassing a diagonal parking space.
(2) Spaces specified as parking and stopping places for
handicapped persons shall be marked and indicated by suitable stationary
signs indicating the location and extent of such places so reserved.

Any person violating any provision of this article shall be subject to penalties as set forth in Article
VI of this chapter.
