When a snow storm occurs, as hereinafter set
forth, which constitutes serious public hazard impairing transportation,
the movement of food and emergency supplies, medical care, fire, health,
police protection and other vital facilities of the Township, a state
of emergency shall be deemed to exist. A state of emergency is hereby
declared to exist within the municipal limits of the Township whenever
there shall be a snowfall of two inches or more, in the opinion of
the Director of Public Works or his designee, and such emergency shall
be presumed to continue for a period of 24 hours after the cessation
of said snowfall.
In order to afford the Township the opportunity
to clear its streets and highways of snow and to open the same during
the period of the emergency, no vehicle, however propelled, except
as herein provided, shall be allowed to stand or park, whether attended
or not, upon any street or highway in the Township, except for picking
up or discharging passengers or for picking up or delivering essential
merchandise or other commodities; provided, however, that such emergency
shall be terminated as to any street or highway when the snow has
been plowed therefrom for the full width of the pavement.
Such emergency shall continue beyond the seventy-two-hour
period above set forth on those streets or highways of the Township
from which the snow has not been removed, and no vehicle shall be
allowed to stand or park, whether attended or not, on such street
or highway until the snow shall have been cleared thoroughly therefrom.
Whenever a vehicle has been parked or left standing
in violation of the provisions of this article, the Chief of Police
or any police officer so designated by the Chief may move or cause
the removal of such vehicle to such place as may be designated by
the Chief of Police for the impounding until the person owning said
vehicle shall pay the reasonable cost of such removal and storage.
Within 24 hours after the vehicle has been so removed, the Chief of
Police or any member of the Police Department acting for the Chief
shall give written notice thereof to the registered owner or owners
if the name or names and address may be ascertained, which notice
may be given by personal service or by mail addressed to said owner
or owners at their last known address.
The removal of vehicles as referred to in the aforementioned §
296-14 to a designated place of impounding shall be carried out only by Township truck operators listed on the rotating list maintained by the Police Department.
After any vehicle removed as aforesaid has been
in the possession of either the Police Department of the Township
of Mansfield for a period of six months, and the owner or owner cannot
be found or refuses to receive and remove such vehicle and pay the
storage costs thereof, then the Chief of Police may proceed to sell
such vehicle in accordance with the provisions of the Laws of the
State of New Jersey.
As used in this article, the following terms
shall have the meanings indicated:
VEHICLE
Every device in, upon, or by which a person or property is
or may be transported upon a highway.
The owner or tenant of lands abutting upon a
public street of the Township of Mansfield, shall and must remove,
or cause to be removed, from the abutting sidewalks of said street,
and from around any fire hydrant located on said premises for a radius
of two feet all snow or ice within 24 daylight hours after the same
shall be formed or fall thereon.

A. No person, firm or corporation, or the owner, tenant or occupant
of any premises abutting on any public street within the jurisdiction
of the Township of Mansfield shall throw, place or deposit any snow,
ice or sleet into or upon any of said Township streets. It is the
intent and purpose of this provision to prohibit all persons from
throwing, casting, placing, plowing or depositing snow, ice and sleet
which has accumulated within the private property or any area outside
of the traveled way or shoulder onto a Township street.
B. No person, firm or corporation, or the owner, tenant or occupant
of any premises abutting on any Township street, if require by necessity
plowing of their driveways to gain access to the public street, shall
plow any snow, ice and sleet into or upon the Township streets, traveled
way or shoulder; rather, all snow, ice and sleet shall be deposited
off the traveled way and shoulder. It is hereby further required,
to facilitate the traffic flow and to maintain the proper width on
the Township streets, that said person or persons or individuals and/or
their agents shall feather the snow along said Township streets so
that same does not encroach upon the traveled way and/or shoulder,
if one exists.
Any owner or tenant who violates the above section
of this article shall, upon conviction thereof, be punished by a fine
not exceeding $250, together with the cost of prosecution incurred
by the Township of Mansfield.
In cases where the owner or tenant shall refuse
or neglect to remove the snow and ice as required by this article,
in the manner and within the time provided herein, the Mayor and Township
Committee, by or under the direction of the Road Supervisor of the
Department of Public Works, shall cause the same to be done.
The cost and expense paid and incurred by the
Township of Mansfield for removing such snow or ice from any sidewalk
or fire hydrant and for forming the pathway, where required, shall
be ascertained by the Committee and certified to the Assessor of the
Township, and such expense shall be added to and form a part of the
tax or taxes next to be levied and assessed on the lot or lots of
land in front of which such sidewalk is, from which snow or ice has
been removed or the pathway formed, to be collected according to law,
and shall be a lien upon said lands until paid; and this liability
of the owner or owners of the said land shall be in addition to his
or her liability to the fine imposed hereunder.
