For the purpose of this chapter, the following
terms, phrases, words and their derivatives shall have the meaning
given herein. When not inconsistent with the context, words used in
the present tense include the future, words in the plural number include
the singular, and words used in the singular include the plural. The
word "shall" is always mandatory and not merely directory.
AN ABANDONED OR JUNKED VEHICLE
Every device of a type which may be registered for the transport
of persons or property on public roads or highways under the Vehicle
Code of the Commonwealth of Pennsylvania, which device has no value
other than scrap or salvage value and is either inoperable or does
not bear a valid up-to-date registration plate issued by the Commonwealth
of Pennsylvania or other state.
PRIVATE PREMISES
Any private lot or area within the Township limits, whether
it be improved in any manner whatsoever or whether it be vacant.
PUBLIC PLACE
Any and all streets, sidewalks, roads or other public ways
and all public parks, squares, spaces or grounds, including all grounds
owned by the Township or available for community use.
TOWNSHIP
The Township of Upper Hanover, Montgomery County, Pennsylvania.
It shall be unlawful for any person to store
or continue to store an abandoned or junked vehicle or any parts thereof
on private premises or on a public place, except in a building or
structure, in a manner which is or may be injurious to the public
health, comfort or safety of the residents of the Township.
Any act in violation of the provisions of this
chapter shall be a public nuisance.
Any Township employee or appointee designated
by the Supervisors of the Township is hereby authorized and empowered
to notify any person violating the provisions of this chapter to either
abate said nuisance or remove and properly dispose of any abandoned
or junked vehicle located on private premises owned or occupied by
such person. Upon failure, neglect or refusal of any such person so
notified to properly abate said nuisance or to properly dispose of
said abandoned or junked vehicle within 10 days of the date of said
notice, the issuing party is hereby authorized and empowered to charge
said person with a summary offense as hereinafter provided.
