An election of the officers of the Town of Farmington shall be held on the Tuesday after the first Monday of November in each odd-numbered year. At each such election there shall be elected seven members of the Town Council, one of whom shall be chosen by the electors of the Town by plurality vote in the Town to be Chair of the Council, three shall be chosen by the electors of the first voting district by plurality vote in said district and three shall be chosen by the electors of the second voting district by plurality vote in said district. At such election held on the Tuesday after the first Monday of November in each odd-numbered year, there shall be elected three Constables, three alternate members of the Town Plan and Zoning Commission and three alternate members of the Town Zoning Board of Appeals, all for terms of two years; three members of the Town Plan and Zoning Commission and three members of the Town Zoning Board of Appeals, all for terms of four years; two members of the Town Board of Assessment Appeals, all for terms of six years; and, at alternating Town elections, four members and five members of the Town Board of Education, respectively, all for terms of four years and a Town Clerk for a term of two years for the 2003 Town election and for a term of four years thereafter. The term of all such officers shall commence on the first Monday of January following their election. All officers shall hold office until their successors are elected and qualify. No Town Treasurer or agent of the Town deposit fund shall be elected.

A. 
The foregoing officers shall be nominated and elected as provided for the nomination and election of Town officers in the General Statutes of the state, provided that, in the case of members of the Council, no person shall vote for more than two of the members to be elected from the voting districts and, in all other cases where two or more persons are to be elected to any office, if the number of offices to be elected is odd, no person shall vote for more than a bare majority of the number and, if the number to be elected is even, no person shall vote for more than one-half of the number, except that in electing members of the Town Board of Education when only four members of the Town Board of Education are to be elected, a person may vote for three such members.

B. 
The maximum number of members of any elective or appointed board, commission, agency, committee or other similar body, except such boards, commissions, agencies and/or committees whose members are elected on the basis of geographical division of the Town, who may be members of the same political party shall be as specified in the following table, contained in C.G.S. § 9-167a, as the same may from time to time be amended.

C. 
Prior to any election for or appointment to any such body, the Town Clerk, in cases of elective offices, and appointing authority, in cases of appointive offices, shall determine the maximum number of members of any political party who may be elected or appointed to such body at such election or appointment. Such maximum number shall be determined for each political party in the following manner: From the number of members of one political party who are members of such body at the time of the election or appointment, subtract the number of members of such political party whose terms expire prior to the commencement of the terms for which such election or appointment is being held or made and subtract the balance thus arrived at from the appropriate number specified in the second column in Subsection B of this section.
D. 
In the case of any election to any such body the winner or winners shall be determined in accordance with the provisions of C.G.S. § 9-167a, Subsection (c), as the same may from time to time be amended.
E. 
If an unexpired portion of a term is to be filled at the same time as a full term, the unexpired term shall be deemed to be filled before the full term for the purpose of applying this section. At such time as the minority representation provisions of this section become applicable to any board, commission, committee, agency or body, vacancies thereafter occurring shall be filled by election or appointment of a member of the same political party as that of the vacating members.
F. 
Nothing in this section shall be construed to repeal or modify the provisions of any special act which provides for a greater degree of minority representation than is provided herein.

Any vacancy in any elective Town office, from whatever cause arising, shall be filled by appointment by the Town Council for the period ending on the first Monday of January following the next Town election, provided that, when the person vacating the office shall have been elected as a member of a political party, such vacancy shall be filled by the appointment of a member of the same political party as that of the former incumbent, unless the incumbent was elected as an independent candidate, in which case his/her successor shall not be an enrolled member of a political party, and further provided that, if the person vacating the office shall have been elected from a voting district, such vacancy shall be filled by the appointment of a qualified elector of such district and of the same political party. If the Council, for a period of 60 days, is unable to obtain a majority or plurality vote necessary to appoint a person to fill a vacancy, the appointment shall be made by vote of only those members of the Council belonging to the same political party as that of the vacating officeholder. If the unexpired balance of the term of the person vacating office extends beyond the first Monday of January following the next Town election, the vacancy for such additional extended period shall be filled by electing an official for the balance of the unexpired term at the regular Town election held on the Tuesday after the first Monday of November.

No person shall be eligible for election to any Town office who is not, at the time of his/her election, a resident and a qualified voter of the Town or, if he/she is elected from a voting district, a qualified voter of such district. A vacancy shall immediately exist if any such person ceases to be both a resident and a qualified voter of the Town. Additionally, a person shall be presumed to have ceased to be a resident if such person's permanent residence is located outside of Town.

There shall continue to be two voting districts, as the same were on the effective date of this Charter, and the number of such districts shall not be increased or diminished nor their boundaries altered, except by ordinance of the Town Council approved by a majority of the electors voting thereon at a regular biennial Town election. The second district shall comprise all land bounded as follows: Beginning at the intersection of the center line of Morea Road with the town line of the Town of Bristol; running thence northerly along the Town lines of the Town of Bristol and the Town of Burlington to the intersection of the Town lines of Burlington, Farmington and Avon; running thence southeasterly and easterly along the town line of the Town of Avon to the former center line of the Northampton division of the New York, New Haven and Hartford Railroad; running thence southwesterly along said center line of said railroad to its intersection with the center line of Brickyard Road; running thence southerly along the center line of said Brickyard Road to its intersection with Farmington Avenue; running thence southerly parallel to the railroad to the center line of the Farmington River; running thence northwesterly along the center line of said river to said center line of the railroad; running thence southerly along said center line of the railroad to its intersection with the center line of Meadow Road; running thence westerly along the center line of Meadow Road to Plainville Avenue; thence continuing westerly along the center line of Morea Road to the place of beginning. The first district shall comprise all other land within the Town. Additional districts may be created pursuant to the Connecticut General Statutes.
