For the purpose of promoting the health, safety, convenience,
morals and welfare of its inhabitants, the City, pursuant to the provisions
of Chapter 40A and Section 29 of Chapter 93 of the General Laws of
the Commonwealth, as from time to time amended, hereby adopts this
chapter, to be known and designated as the "Zoning Ordinance of the
City of Waltham."

The City of Waltham Zoning Ordinance is adopted pursuant to
and under the authority of the Zoning Act of the Commonwealth of Massachusetts,
Chapter 40A of the General Laws.

The purposes and objectives of this chapter are to implement
the zoning powers granted to the City under the Constitution and statutes
of the commonwealth and include, but are not limited to, the following:
to promote convenience, morals and welfare; to lessen congestion in
the street; to conserve health; to secure safety from fire, flood,
panic and other dangers; to provide adequate light and air; to prevent
overcrowding of land; to avoid undue concentration of population;
to encourage housing for persons of all income levels; to facilitate
the adequate provision of water, water supply, transportation, drainage,
sewerage, schools, banks, open space recreation, recreational facilities
and other public requirements; to conserve the value of land and buildings,
including the conservation of natural resources and the prevention
of blight and pollution of the environment; to encourage the most
appropriate use of land throughout the City, including consideration
of the recommendations of the Master Plan, if any, adopted by the
Planning Board and the Comprehensive Plan, if any, of the regional
planning agency; and to preserve and increase amenities by the promulgation
of regulations to fulfill said objectives. Said regulations include,
but are not limited to, restricting, prohibiting, permitting and regulating:
1.31.
Uses of land, including wetlands and land deemed subject to seasonal
or periodic flooding.
1.32.
Size, height, bulk, location and use of structures, including buildings
and signs, except that billboards, signs and other advertising devices
are also subject to the provisions of Sections 29 through 33, inclusive,
of Chapter 93 and to the provisions of Chapter 93D.
1.33.
Use of bodies of water, including watercourses.
1.34.
Noxious uses.
1.35.
Areas and dimensions of land and bodies of water to be occupied by
the uses and structures, courts, yards and open spaces.
1.36.
Density of population and intensity of use.
1.37.
Accessory facilities and uses, such as vehicle parking and loading,
landscaping and open spaces.
1.38.
The development of the natural, scenic and aesthetic qualities of
the community.

Nothing in this chapter shall be construed to regulate or restrict
the use of materials or methods of construction of structures regulated
by the State Building Code.
