Wherever a space is marked off on any street for the parking of an individual vehicle, every vehicle parked there shall be parked wholly within the lines bounding that space, and it shall be a violation of this article for any person to park a vehicle or allow it to remain parked otherwise.

(1) 
It shall be unlawful for any person to park a Registration Class 9 to Class 25 truck, truck tractor, trailers, commercial buses and the largest of the three classes of recreational vehicles on any street or parts of streets within the districts defined in Appendix B-Street Map-Area Delineation attached to the Benchmark Civil Engineering Services study, referenced herein as Exhibit A,[1] made a part hereof and incorporated herein by reference.

(2) 
The aforementioned Benchmark Civil Engineering Services sets forth in Appendix A, a review of the roadways throughout the Township and the resulting deficiencies that warrant restricting the parking of trucks and larger vehicles on public rights-of-way.
(3) 
The areas identified in Appendix B of the Benchmark Traffic/Engineering Study contain similar uses, which form a zone. There are 15 in number, which are color-coded in the street map attached to Appendix B.
(4) 
Class of vehicles subject to parking restrictions.
(a) 
This subsection applies to any vehicle registered as a Class 9 through Class 25 (Pennsylvania Registration Classification, hereinafter "PRC") vehicle or above, and any vehicle otherwise with a gross vehicle weight over 26,001 pounds.
(b) 
This subsection applies to commercial passenger buses and the largest of the three classes of recreational vehicles.
(c) 
This subsection does not apply to vehicles registered in Class 1 through Class 8 (PRC) unless the vehicle in these classifications is attached to a trailer.
(5) 
Parking of Class 9 through Class 25 vehicles, including trucks, truck tractors, trailers, construction equipment or commercial passenger buses and the largest of the three classes of recreational vehicles.
(a) 
No person shall park a vehicle registered as a Class 9 through Class 25 (PRC) above, including a truck, truck tractor or trailer, upon any street within the Township unless the truck trailer has attached thereto a means of mechanical traction so constructed or designed for the purpose of pulling or drawing such trailer, and the truck tractor or trailer is only parked on the street for pick-up or delivery purposes in accordance with the time provisions and limitations of this subsection.
(b) 
No person shall stand or park any vehicle defined as a class of vehicle specifically prohibited in this subsection, including a truck, truck tractor and trailer or tri-axle dump truck, upon any public street that lies within any zoning district in Whitehall Township except as provided in Subsection B(5) below. For the purposes of this subsection, such area shall include all streets that either lie within or are abutting the Township lines.
(c) 
Nothing in this subsection shall be intended to prohibit the parking of any truck, tractor, truck tractor and trailer or tri-axle dump truck for the purpose of the delivery or pickup of merchandise, material, or goods or in the performance of construction operations on an adjoining location from 7:00 a.m. to 9:00 p.m., provided that:
[1] 
The parking of said vehicle shall terminate immediately upon the conclusion of the services, delivery or pickup of merchandise, material or goods; and
[2] 
Such parking shall be limited to a period of no longer than 10 hours, or until the delivery or pickup operation is completed, whichever is shorter.
(d) 
Nothing in this subsection shall be intended to prohibit the parking of any vehicle specifically permitted by the Township, or to vehicles responding to emergencies, or to any vehicle involved in the moving of household goods, provided that a permit has previously been issued by the Township pursuant to approved Township ordinance requirements.
(e) 
Nothing in this subsection shall be intended to prohibit the parking of any vehicles of service companies, contractors, repairmen, delivery trucks or others actually engaged in working operations during the actual period of such work between the hours of 7:00 a.m. and 9:00 p.m. Time restrictions under this section do not apply for emergency service calls.
(f) 
Notification of violation is not required for the Township Police Department to issue a citation in violation of this subsection.
(6) 
All areas of the Township to be controlled by this subsection shall be signed in accordance with Exhibit A, which adopts the standards of the Commonwealth of Pennsylvania and the Motor Vehicle Code of the Commonwealth of Pennsylvania.
(7) 
Penalty. For violation of § 15-39 of the Whitehall Township Codification, Motor Vehicles and Traffic, or any subsection thereunder, the following penalty shall be imposed: For violation of this section, the owner or operator within 10 days of the time when such notice was attached to his motor vehicle conveyance, pay as a penalty, in full satisfaction of each violation, the sum of $50 and after 10 days, but within 20 days of violation, the sum of $100. In addition to the fine, the Police Department may have the vehicle or trailer immediately towed if the vehicle is in its judgment posing an immediate safety hazard.

A. 
Only angle parking shall be permitted on the following portions of streets:

B. 
On all streets where angle parking is required, every vehicle parked at the angle shall be parked with its front nearest the curb.
It shall be unlawful for any person to park a vehicle or to allow the same to remain parked, at any time between 8:00 a.m. and 10:00 a.m. on any of the following portions of the highways of the Township of Whitehall on the days hereby respectively designated for street sweeping purposes:

It shall be unlawful for any person to stop, stand or park a vehicle (other than a pedalcycle) on the roadway side of any vehicle stopped or parked at the edge or curb of any street, except that standing or parking for the purpose of loading or unloading persons or property shall be permitted on the following named streets on Monday through Saturday, between the hours of 9:00 a.m. and 11:30 a.m. and between the hours of 1:30 p.m. and 4:00 p.m., and for no longer than necessary for the loading or unloading.

A. 
Findings and purpose. The Township of Whitehall finds that:
(1) 
Certain residential areas in the Township are subjected to commuter vehicle parking, therefore, depriving the residents of those areas of spaces in which to park their own vehicles.
(2) 
Those residential streets are also subjected to a high degree of commuter traffic which substantially reduces the quality of the ambient air level.
(3) 
The establishment of a parking permit program for certain affected areas should facilitate efficient movement of traffic by providing for parking preference during certain hours of the day and days of the week. Therefore, the Board of Commissioners considers it to be in the interest of the people of the Township to provide for the establishment of a residential permit parking program to insure primary access to available parking spaces by neighborhood residents and also to provide a cleaner ambient air level.
B. 
Definitions. For the purpose of this section, words and terms listed in this subsection, as follows, shall have the following meanings:
COMMUTER VEHICLE
A motor vehicle parked in a residential area by a person not a resident of that residential area.
PROPRIETOR
A person who owns or leases real estate within a residential area of which he is not a resident, but who owns or manages a business enterprise or professional office maintained at that address; for the purpose of this section, a proprietor shall be entitled to one parking permit for that business or professional office address.
RESIDENT
A person who owns or leases real property within a residential area and who maintains either a voting residence, or bona fide occupancy, or both, at that address.
RESIDENTIAL AREA
A contiguous area containing public highways or parts of public highways primarily abutted by residential property or residential and non-business property (such as schools, parks, places of worship, hospitals and nursing homes).
C. 
Criteria. The residential areas designated in Subsection D of this section are those deemed impacted and hence eligible for residential parking on the basis of the following criteria:
(1) 
During any period between the hours of 7:00 a.m. and 6:30 p.m., Monday through Saturday, except legal holidays, the number of vehicles parked (or standing), legally or illegally, on the streets in the area is equal to 70% or more of the legal, on-street parking capacity of the area. For the purpose of this criterion, a legal parking space shall be 20 linear feet.
(2) 
Specific areas.
(a) 
During the same period as specified in Subsection C(1), directly above, 10% or more of the vehicles parked (or standing) on the streets in the area are not registered in the name of a person residing in the area. For the purpose of this criterion, the latest available information from the Bureau of Motor Vehicles and Licensing of the Pennsylvania Department of Transportation regarding registration of motor vehicles shall be used.
(b) 
Provided that in determining that a specific area identified as impacted and eligible for residential permit parking is designated as a residential permit parking area, the following factors are taken into consideration:
[1] 
The local and metropolitan needs with respect to clean air and environment.
[2] 
The possibility of a reduction in total vehicle miles driven in the Township.
[3] 
The likelihood of alleviating traffic congestion, illegal parking and related health and safety hazards.
[4] 
The proximity of public transportation to the residential area.
[5] 
The desire and need of the residents for residential permit parking and their willingness to bear the administrative costs in connection with it.
[6] 
The need for parking in excess of the residential permit parking program in proximity to establishments located in the residential permit parking area and used by the general public for religious, health or educational purposes.
D. 
Designation of residential permit parking areas.
(1) 
The following are designated as residential permit parking areas:

**Permit parking is required on any and all days in which the Whitehall-Coplay School District is in session between the hours of 7:00 a.m. and 3:00 p.m. Permits shall (i) be issued by the Chief of Police to each affected household or resident, (ii) be hung on the rear view mirror, (iii) be used for licensed motor vehicles registered at the address of the household to which the permit is assigned or for licensed motor vehicles of visitors of the household, (iv) be issued at no cost to the household or resident, (v) be valid until revoked by the Chief of Police, and (vi) not have vehicle or driver's information set forth thereon. Penalties for violations of the restrictions set forth herein for permit parking in the Mickley Garden Subdivision shall be $10 per violation. The Bureau of Police shall maintain an inventory of all permits and the households to which said permits are assigned.
(2) 
Signs shall be erected along the streets in each residential permit parking area, indicating the days, hours, locations and conditions under which parking shall be by permit only.
E. 
Application for permit. Application for a residential parking permit shall be made to the Chief of Police by the person desiring the permit, who shall be only the owner or the driver of a motor vehicle who resides on or is a proprietor of property immediately adjacent to a street or other location within a residential parking permit area. A separate application shall be required for each motor vehicle, and each application shall be accompanied by a permit fee, set pursuant to a resolution of the Board of Commissioners which shall be for the use of the Township, to be applied to the cost of administering the residential permit parking program. Each application shall contain the following information: the name of the owner or the driver, as the case may be, of the motor vehicle; the address of the resident or the proprietor, as the case may be; the make, model and registration number of the motor vehicle; and the driver number as taken from the applicant's current driver's license. At the discretion of the Chief of Police, the applicant shall be required, at the time of making application, to present his driver's license and the vehicle registration card.
F. 
Issuance of permit. Upon receipt of the application and the permit fee, and determination by him that the information upon the application shows that the applicant is entitled to a residential parking permit, the Chief of Police shall issue to the applicant a residential parking permit, which shall be valid for the remainder of the calendar year. The permit shall display the serial and registration numbers of the motor vehicles, the residential parking area number, and the expiration date. The permit shall be renewable annually before the expiration date, upon making application for renewal and payment of the permit fee. It shall be unlawful and a violation of this section for any person to display other than the current and valid permit while standing or parking in a residential permit parking area at any time when those permits are to be displayed.
G. 
Temporary and exemption parking permits. Temporary parking permits may be issued by the Chief of Police, upon payment of a fee established pursuant to a resolution, to bona fide visitors of residents of a designated residential permit parking area, and exemption parking permits may be issued, without payment of a fee, to handicapped persons.
H. 
Responsibility of permit holder.
(1) 
Notwithstanding any provision of this section to the contrary, the holder of a residential parking permit shall be permitted to stand or park a motor vehicle operated by him in any designated residential parking area during those times when parking of motor vehicles is permitted in that area. While a vehicle for which a residential parking permit has been issued is so parked, that permit shall be displayed so as to be clearly visible through the windshield of the vehicle. A residential parking permit shall not guarantee or reserve to the holder a parking space within a designated residential permit parking area.
(2) 
A residential parking permit shall not authorize its holder to stand or park a motor vehicle in any place where or at any time when stopping, standing or parking of motor vehicles is prohibited or set aside for other specified types of vehicles, nor shall the permit exempt its holder from the observance of any traffic or parking regulation other than residential permit parking regulation or restriction.
(3) 
No person other than the permit holder whose name appears on the permit shall use a residential parking permit or display it on a vehicle operated; any such use or display by a person other than the permit holder shall constitute a violation of this section by the permit holder and by the person who so used or displayed the parking permit.
(4) 
It shall constitute a violation of this section for any person falsely to represent himself as eligible for a residential parking permit or to furnish false information in an application to the Chief of Police in order to obtain a residential parking permit.
(a) 
Revocation of permits. The Chief of Police shall have authority to revoke the residential parking permit of any permit holder found to be in violation of any provision of this section. Upon written notification to him of the revocation, the permit holder shall surrender the permit to the Chief of Police. Failure to do so, when so requested, shall constitute a violation of this section. Provided: any person receiving such a notice may, within 10 days after the date of the notice, appeal to the Board of Commissioners for a hearing on the revocation, and the decision of the Board of Commissioners shall be final.
Any person who violates any provision of this article shall, upon conviction, be sentenced to pay a fine of not more the $20 and costs or prosecution, except for violations of handicapped designated parking spaces, provided:
A. 
Violation procedures.
(1) 
It shall be the duty of the police officers and of the parking enforcement personnel of the Township to report to the appropriate official all violations of any provision of this article indicating in each case:
(a) 
The section violated;
(b) 
The license number of the vehicle involved in the violation;
(c) 
The location where the violation took place; and
(d) 
Any other facts that might be necessary in order to secure a clear understanding of the circumstances attending to the violation.
(2) 
The police officer making the report shall also attach to or place upon every such vehicle illegally parked a notice stating that the vehicle was parked in violation of the ordinances of Whitehall Township. The notice shall contain instructions to the owner or driver of the vehicle that he will report to the office of the Chief of Police and pay the sum of $20 within 48 hours after the time of the notice, or if he will place the sum of $20 by check or money order, in the U.S. Mail addressed to the Whitehall Township Police Department and postmarked within 48 hours of the violation, that act will save the violator from prosecution for that offense and from payment of the full time and costs prescribed in the first sentence of this section.

B. 
Illegal parking in handicapped space. Except for person parking vehicles lawfully bearing a handicapped or severely disabled veteran registration plate or displaying a handicapped or severely disabled veteran parking placard when such vehicles are being operated by or for the transportation of a handicapped person or a severely disabled veteran, no person shall park a vehicle on public or private property reserved for a handicapped person or severely disabled veteran which property has been so posted in accordance with departmental regulations which shall require a sign stating the amount of the penalty indicated in this subsection of $50 and indicating that vehicles in violation of this subsection may be towed. Any vehicle which is unlawfully parked in a designated handicapped parking are may be removed from that area by towing and may be reclaimed by the vehicle owner upon payment of the towing costs. The fine for parking illegally in a properly designated handicapped parking space without the display of such placard of license shall be $50 in accordance with the provisions of 75 Pa.C.S.A. § 3354(d)(3)(i).
