It shall be unlawful for the owner of any animal, or any person having possession or custody of any animal, to cause, suffer or permit an animal to be present upon public or privately owned parks and playground areas open to the public in Whitehall Township. Exceptions will be made for those animals which are permitted by federal, state or local regulation or statute, such as, but not exclusively, service/assistance animals for persons with disabilities. "Owner" shall mean any person or person, firm, association or corporation owning, keeping or harboring an animal.
It shall be unlawful for the owner of any animal, or any person having possession or custody of any animal, to permit the same to discharge or deposit any fecal matter on public or privately-owned parks and playground areas open to the public in the Township.
The owner of any animal shall be required to remove immediately any fecal matter deposited by said animal on the property of another and dispose of the fecal matter in a sanitary manner, to prevent any such accumulation from becoming a danger to the public health. Property of another shall mean publicly or privately-owned property.

Any person, firm or corporation who shall violate any provision of this article shall, upon conviction thereof, be sentenced to pay a fine of not more than $1,000 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 30 days. Each day that a violation of this article continues shall constitute a separate offense.
