Pursuant to § 187 of the General Municipal Law of the State
of New York, entitled "Local Option" and subject to the provisions
of Article 9-A of the General Municipal Law and pursuant
to the direction contained in Subdivision 2 of § 9 of Article
1 of the Constitution of the State, whereby the legislature grants
to every municipality the right, power and authority to authorize
the conduct of games of chance by authorized organizations within
the territorial limits of such municipality and further provides that
a local law or ordinance adopted by a town shall be operative in any
village or within any part of any village located within such town
if, after adoption of such local law, the Board of Trustees of such
Village adopts a local law subject to a permissive referendum as provided
in Article 9 of the Village Law, authorizing the issuance of licenses
by the Town for games of chance within such Village, the Village of
Depew hereby elects to have such town enact enactment to be applicable
to the Village of Depew.
This section may be repealed only by a local law which shall also
be subject to a permissive referendum or by enactment of a local law
authorizing games of chance as provided in § 188 of Article
9-A of the General Municipal Law.
Authorized organizations located in that portion of the Village of
Depew within the boundaries of the Town of Cheektowaga may obtain
their licenses for games of chance from the Town of Cheektowaga, New
York, and subject to the Games of Chance Law of the State of New York.

Any violation of any provision of this chapter shall be punishable as provided by § 1-10 of Chapter 1 entitled "General Provisions" of this Code.
