The following words and phrases, when used in
this chapter, shall have the meanings ascribed to them in this section
as follows:
PERMANENT
A fixed mobile home or trailer which shall be fixed, continuing,
lasting, stable and shall be securely attached to the real estate
so that the same may not be moved without incurring substantial damage.
The criteria to determine if a mobile home shall be permanent shall
be predicated upon the occurrence of three or more of the following
requirements:
A.
Fixing or securing the trailer to the real estate
or mobile home pad by permanent means.
B.
Removal of axles, wheels or tongs.
C.
Connecting a mobile home to underground electric,
water and sewage disposal systems.
D.
Installation of permanent skirting, appurtenant
structures or outbuildings which shall be affixed to the trailer.
E.
Fixing to the trailer any construction which
would require the obtaining of a building permit pursuant to the prevailing
East Manchester Township building permit ordinances.
TEMPORARY
That which shall be used for a limited time only and shall
not be considered permanent as set forth herein.

A. It shall be unlawful for any person, partnership,
association or corporation to use, rent, maintain, occupy or own any
house trailer as a permanent residence or dwelling or place of business
within the confines of the Township of East Manchester for a period
longer than 14 days in any 12 consecutive months without a trailer
permit from the Zoning Officer of East Manchester Township.
B. Any house trailer or mobile home used as a temporary
residence, dwelling or place of business shall be exempt from the
provisions contained herein.

Any person desiring a trailer permit shall secure
an application for a trailer permit from the Zoning Officer of East
Manchester Township and submit said application fully completed, setting
forth the name and address of the applicant, area to be used for trailer
purposes, the plan for water supply and the method of disposal of
sewage, garbage and refuse. A fee as set forth from time to time by
the Board of Supervisors shall be paid with the application, and, upon receipt of said sum and the application, the
Zoning Officer, upon the authority granted by the Board of Supervisors,
shall cause an investigation to be made and, if satisfied that the
proposed trailer area does not interfere with the health, comfort
and safety of its citizens, shall issue a permit for one year. Should
the Zoning Officer, upon investigation, find that the health, comfort
and safety of the citizens of East Manchester Township will be interfered
with, no permit shall be issued.

All permits may be renewed yearly for a fee
as set forth from time to time by the Board of Supervisors.
No permit shall be assigned or transferred without
an application for a new permit by the proposed assignee or transferee.
The violation of this chapter shall be deemed
to be and constitute a nuisance. Whenever it is found that any person,
partnership, association or corporation maintains such nuisance within
the Township of East Manchester, said Supervisors of said Township
shall serve notice to that effect upon the person, partnership, association
or corporation maintaining such nuisance. Such notice shall sufficiently
describe the locations of the house trailer and require the same to
be removed.

Any person who violates any provisions of this
chapter shall commit a criminal offense, and shall, upon being found
guilty by a Magisterial District Judge, after hearing, pay a fine
not to exceed $1,000, together with all court costs as permitted by
law. In default of payment thereof, the defendant may be sentenced
to imprisonment for a term not exceeding 90 days. Each day of violation
shall constitute a separate offense, which shall be subject to prosecution
as such. For purposes of this section, the Board of Supervisors of
East Manchester Township hereby appoints the Township Manager, Secretary,
Zoning Officer, Permit Officer or Codes Enforcement Officer as authorized
representatives, any one of whom may commence and pursue enforcement
proceedings pursuant to this section.
