A certain document, three copies of which are on file in the office of the Secretary of the Township of Loyalsock, being marked and designated as the International Property Maintenance Code, 2009 Edition, including Appendix A, as published by the International Code Council, and is hereby adopted as the Property Maintenance Code of the Township of Loyalsock, in the State of Pennsylvania, for regulating and governing the conditions and maintenance of all property, building and structure; by providing the standards for supplied utilities and facilities and other physical things and conditions essential to ensure that structures are safe, sanitary and fit for occupation and use; and the condemnation of buildings and structures unfit for human occupancy and use and the demolition of such existing structures as herein provided; providing for the issuance of permits and collections of fee therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said Property Maintenance Code and/or the Pennsylvania Uniform Construction Code on file in the office of the Township of Loyalsock are hereby referred to, adopted and made a part hereof, as if fully set out in this article, with the additions, insertions, deletions and changes, if any, prescribed in § 100-30 of this article.

The following sections are hereby revised:
A. 
Section 101, General.
(1) 
Section 101.1, Title, is amended to insert "Township of Loyalsock."
(2) 
Section 101.2.1, Commercial Inspections, is amended to read as follows:
"Every commercial business located within Loyalsock Township is required to be inspected for fire and safety compliance by the Building Official, or his/her designee. This required inspection shall be completed once every three years for each business."
B. 
Section 103.5, Fees, is amended to read as follows:
"The fees for activities and services performed by the Department in carrying out its responsibilities under this code shall be set forth by resolution from time to time by the Township Board of Supervisors."
C. 
Section 106.4, Violation penalties, is amended to read as follows:
"Any person who shall violate a provision of this code or shall fail to comply therewith, or with any of the requirements thereof, shall be punishable by a fine not less than $100 nor more than $2,000, plus cost, and, in default of payment of such fine and costs, to imprisonment not to exceed 30 days. Each day's continuance shall constitute a separate offense."
D. 
Section 112.4 is amended to insert "$100" and "$2,000."
E. 
In Section 302.3, Sidewalks and driveways, add the following sentence to the paragraph: "Hazardous conditions shall include, but not necessarily be limited to, joint or crack offset 1/2 inch or greater, severe spalling (pitting) or surface deteriorations, severely cracked or shattered sidewalks or other conditions or combination of conditions causing an unsafe surface in the opinion of the Building Official, Township Manager or his or her authorized representative."
F. 
Section 302.4, Weeds, is amended to insert "10 inches."
G. 
Section 304.14, Insect screens is amended to insert the following two dates: from "March 1" to "October 31."
H. 
Section 403.6, Commercial Kitchen Cooking Hoods, is amended to read as follows:
"Type 1 and Type 2 kitchen hoods shall be cleaned and maintained in accordance with the International Fire Code."
I. 
Section 602.3, Heat supply, is amended to insert the following two dates: from "September 1" to "March 31."
J. 
Section 602.4, Occupiable work spaces, is amended to insert the following two dates: from "September 1" to "March 31."
K. 
Section 607.1.2, Exhaust System Ducts, is amended to read as follows:
"Duct systems used in conjunction with any kitchen exhaust hood or other commercial or industrial hood shall be cleaned and maintained in accordance with accepted practices or as directed by the Building Official or other Township official."
Nothing in this article or in the Property Maintenance Code hereby adopted shall be construed to affect any suit or proceeding impending in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing, under any act or ordinance hereby repealed as cited in § 100-30 of this article, nor shall any just or legal right or remedy of any character be lost, impaired or affected by this article.
The Secretary is hereby ordered and directed to cause this article to be published.
