It shall be the responsibility of the person, contractor, or
public utility (as required under Section 16:25-9.2 of the New Jersey
Administrative Code) wishing to conduct work on, under or above the
roadway to contact the Traffic Bureau of the Jackson Township Police
Department in order to arrange a preconstruction meeting in order
to submit plans for the safe movement of traffic during such period
of construction of work. Any person, contractor or utility who fails
to comply with this section prior to the start of such work, or whose
plans are not approved by the Traffic Bureau of the Jackson Township
Police Department, is in violation of this section.
Trained and qualified traffic directors or flagging personnel
shall be posted at all construction or maintenance sites when determined
by the Traffic Bureau of the Jackson Township Police Department that
same is necessary to provide for the safety and expeditious movement
of traffic.
All construction sites shall have proper and ample guards, barricades,
signs and lights maintained on site to sufficiently warn users of
the road, street or highway of the dangers attendant to the project,
from the time the opening, trench or road construction is started
until same is completely restored and completely reopened to public
travel. The type of guard, barricade, sign or light to be utilized
shall be in compliance with specifications or standards contained
in the Manual on Uniform Traffic Control Devices, 1988 Edition, or
its latest revisions.
Road closing and/or traffic detours shall not be permitted unless
approved by the Traffic Bureau of the Jackson Township Police Department.
There shall be no construction, maintenance operations or utility
work on any roadway in the Township of Jackson before the hour of
8:00 a.m. or after 5:00 p.m., with the exception of emergency work.
This time limit may be adjusted to permit work prior to 8:00 a.m.
or after 5:00 p.m. by the Traffic Safety Office of the Jackson Township
Police Department. If it is determined by the Traffic Safety Office
that the construction or maintenance operation would cause a substantial
delay in traffic or cause a safety or health hazard, the work shall
then be permitted only between 8:00 a.m. and 5:00 p.m.
The person, contractor or utility responsible for the construction
site shall provide the Police Department and Traffic Bureau with at
least two emergency contact twenty-four-hour phone numbers prior to
the start of any work. If for any reason the emergency contact person
cannot be reached or does not respond to a call from the Police Department
to correct a hazardous condition, the Township may respond to correct
the hazard. The reasonable fees for such emergency service shall be
charged to the bonded contractor responsible.
The Traffic Bureau of the Jackson Township Police Department
shall have the authority to stop work, including but not limited to,
the backfilling of open excavations, the removal of equipment and
vehicles, the removal of any stored materials within the roadway,
safety hazards or for any violation of this section.

Any person, contractor or utility who commits a violation of
this article shall, upon conviction thereof for a first offense, pay
a fine of not less than $100 nor more then $2,000 and/or be imprisoned
in the county jail for a term not exceeding 90 days. A separate offense
shall be deemed committed on each day during or on which a violation
occurs or continues.
