Pursuant to Section 11 of the Uniform Fire Safety Act (P.L.
1983, c.383), the New Jersey Uniform Fire Code shall be locally enforced
in the Municipality of the Township of Deptford.

The local enforcing agency shall be the Bureau of Fire Prevention
of the Township Fire District established pursuant to Section 2-22
of this Code and which sets forth the boundaries of the Fire District.

The local enforcement agency shall enforce the Uniform Fire
and Safety Act and the Codes and regulations adopted under it in all
buildings, structures and premises within the established boundaries
of the Township, other than owner-occupied one and two-family dwellings,
and shall faithfully comply with the requirements of the Uniform Fire
Safety Act and the Uniform Fire Code.

The local enforcing agency shall carry out the periodic inspections
of the life hazard uses required by the Uniform Fire Code on behalf
of the Commissioner of Community Affairs.

The local enforcing agency shall be part of the Township Fire
District. Such funds as may be necessary to support the operations
of the agency shall be raised by the District in the manner provided
by law.

a.
Appointment of fire official. The local enforcing agency shall be
under the supervision of a Fire Official who shall be the Fire Marshal
and appointed by the Board of Fire Commissioners of the Township Fire
District. In making the appointment, the appointing authority shall
make the appointment from among those persons that they shall consider
qualified, which persons shall have been certified pursuant to the
provisions of Title 5.
b.
Term of office. The Fire Official/Fire Marshal shall serve for a
term of two years. Any vacancy shall be filled for the unexpired term
in accordance with the provisions of New Jersey Administrative Code,
Title 5, Chapter 18A, Subchapter 4.
c.
Inspectors and employees. Such inspectors and other employees as
may be necessary in the local enforcing agency shall be appointed
by the Township Board of Fire Commissioners upon the recommendation
of the Fire Official.
d.
Removal from office. The Fire Official/Fire Marshal, inspectors and
other employees of the enforcing agency shall be subject to removal
by the Township Board of Fire Commissioners for inefficiency or misconduct.
The Fire Official, inspector or employee to be so removed shall be
afforded an opportunity to be heard by the appointing authority or
a designated hearing officer.

Pursuant to Sections 15 and 17 of the Uniform Fire Safety Act,
any person aggrieved by any order of the local enforcement agency
shall have a right to appeal to the Construction Board of Appeals
of the County of Gloucester.

The life hazard fees required pursuant to this section shall
be those required pursuant to the Uniform Fire Safety Act and the
regulations of the New Jersey Department of Community Affairs, including
any amendments or supplements thereto.

All of the land lying and being within the corporate boundary
lines of the Township are hereby established and designated as the
Fire District of the Township.

Pursuant to the provisions of the statutes of the State of New
Jersey in such case made and provided, the legal voters of the Township
shall by ballot determine the amount of money to be raised for the
ensuing year and elect a Board of Fire Commissioners to consist of
five persons in accordance with the provisions of the statutes.

The Board of Fire Commissioners shall be responsible for the
administration of the Fire District pursuant to the provisions of
the statutes of the State of New Jersey in such case made and provided.

All Fire Departments and Fire Districts heretofore created are
hereby continued in the manner designated by ordinance.

All multiple-family dwelling units within the Township classified
as R-1 and/or R-2 as defined by the New Jersey Construction Code shall
be required to register with the Bureau of Fire Prevention of the
Deptford Township Fire Department and complete forms provided by the
Bureau. These multiple-family dwelling units shall be inspected periodically,
but not less than once every 12 months.

All assembly, commercial, industrial and multifamily dwelling
uses within the Township of Deptford shall be required to register
with the Bureau of Fire Prevention of the Deptford Township Fire Department
and complete forms provided by the Bureau. These uses shall be inspected
periodically, but not less than once every 12 months. Multifamily
dwelling units shall have no less than 20% of the complex inspected
annually so that the entire complex is inspected once every five years.

The following uses shall be exempt from the payment of inspection
fees imposed by this section.
a.
All fire/rescue stations;
b.
All Township owned and operated buildings;
c.
All county owned and operated buildings;
d.
All State owned and operated buildings;
e.
All Federally owned and operated buildings.
f.
All State registered Life Hazard Uses;
g.
All uses required to obtain all annual permit in accordance with
the N.J. Uniform Fire Code (N.J.A.C. 5:70-1.1 et seq.);
h.
Churches.

The above fees shall apply if the non-life hazard use was cited
for a violation and this violation causes the need for suppression.

All properties within the Township having an automatic fire
alarm system or a fire sprinkler system shall be equipped with a key
box. This shall not apply to owner occupied one and two-family dwellings.

The key box shall be of a UL type and approved by the Township
Fire Official. The rapid entry key box shall be installed in a location
approved by the Fire Official.

The rapid key boxes shall contain the following:
a.
Keys to locked points of egress, whether on interior or exterior
of such buildings;
b.
Keys to the locked mechanical rooms;
c.
Keys to the locked elevator rooms;
d.
Keys to the elevator controls;
e.
Keys to any fence or secured areas;
f.
Keys to any other areas as directed by the Fire Official;
g.
A floor plan of the rooms within the building.

Any building owner violating this section shall be subject to
penalties set forth in the Uniform Fire Code.

The outdoor storage of rubber tires and/or recycled rubber products
may create a fire and health hazard; and the Township wishes to regulate
the amount of rubber tires and/or recycled rubber products that may
be stored in any one location. N.J.A.C. 5:18-4.5 provides that a municipality
may, by ordinance, make its Fire Code more restrictive than the Uniform
Fire Code.

All tires stored outdoors in the Township shall be stored in
accordance with the National Fire Protection Association's Standard
No. 231D, 1989 Edition, Appendix "C", except as modified herein.

The number of loose tires, mounted or unmounted, to be permitted
to be stored outside any one lot shall not exceed 500 tires. There
shall be no distinction between new or used tires for the purposes
of this section.

Tires shall be stored in the following manner.

Any business that recycles used tires or other rubber products
shall not store the products in the same area as the processing plant.
The products shall be packaged for storage as soon as possible after
processing and removed to buildings that meet or exceed the requirements
for storage of such materials as determined by the Uniform Construction
Code. The process of recycling used tires into other products shall
conform and comply with any and all other regulations that may be
established by the Township Fire Official.

The provisions of subsections 12-6.1 and 12-6.2 shall not apply
to any business that recycles used rubber tires into another product
on site. In such a case, the business may store only the number of
tires that may be recycled in one business day. Tires must be stored
in a suitable enclosure that meets Township and State regulations.

Any person who violates these provisions shall be liable for
penalties as set forth in the Uniform Fire Code.
