This section shall be known as the "Refuse and Garbage Collection
Regulation of the Township."

For the purpose of this section, the terms used herein are defined
as follows:
All waste generated by any industrial or manufacturing concern
of any kind whatsoever and all bulky waste as defined by N.J.A.C.
7:26-1.4, which shall include but not be limited to the following:
all items which exceed the size or weight requirements of subsection
18-1.4b, tree trunks or large limbs or stumps, auto bodies or any
part thereof, demolition or construction materials, appliances, furniture
and drums.
A structure, or an entirely self-contained portion thereof,
which is designed for and occupied principally as a place of residence
for one housekeeping unit. A dwelling unit must be suitable for year
round occupancy and must contain facilities for cooking, sleeping,
bathing, and human sanitation which are for the exclusive use of the
occupants of the dwelling.
All refuse, entrails and waste of animals and fish and all
vegetable matter which has been or was intended to be used as food;
all clam, oyster, crab and lobster shells; and all other material
so specified by the State of New Jersey.
All waste which is deemed to be chemical waste, hazardous
waste or infectious waste as defined by N.J.A.C. 7:26-1.4, and which
are flammable, corrosive or explosive or which by themselves or in
combination with other waste could be hazardous to life or property.
Any apartment building, garden apartment building or complex
or rental housing complex containing more than four dwelling units.
Any person, firm, partnership, association, corporation,
company or organization of any kind.
All solid wastes, both combustible and noncombustible, such
as paper, wrappings, cardboard, tin cans, yard clippings, leaves,
glass, rags, waste wood or cardboard, and other combustible solids
of a nonvolatile or explosive nature, bedding, crockery and similar
materials, ashes, street cleaning and dead animals, except bulky and
industrial waste and hazardous waste, as defined in this section.
Any single family home, or any housing complex containing
four or less dwelling units, plus any housing complex consisting of
five or more dwelling units in which the majority of such units are
separately owned in fee or as condominiums. The ownership of 50% of
more of the dwelling units in any such complex by a single individual,
a group of individuals or entity(s) shall disqualify such complex
from being a single-family dwelling for purposes of this section.

a.
The Township of Deptford through its Public Works Department or through
a duly authorized contractor hereinafter referred to as the "collector"
may collect and remove garbage and refuse except bulky and industrial
and hazardous waste from single-family dwellings which refuse and
garbage is generated within the Township of Deptford by such dwelling.
Nothing contained herein shall required such collector to enter on
private property to collect such garbage or refuse.
b.
This section shall not prohibit the actual producers of refuse, or
the owners of premises upon which refuse has accumulated, from personally
collecting, conveying and disposing of such refuse or from contracting
with rubbish contractors, provided that such producers or owners comply
with the provisions of this section and with any other applicable
statute, rule or ordinance of the State of New Jersey and/or the Township
of Deptford.
c.
Pickup location for garbage and refuse shall be at the roadside adjacent
to the property being serviced; however, where the interest of the
public safety and/or convenience of collection requires a redesignation
of a pickup area, the Township Manager may designate such location
upon seven days' written notice to the affected property owner.
Service of notice may be made by ordinary mail or by personal service
to the occupant of the premises, if any. Any affected resident contesting
the redesignation of the trash and rubbish collection side may appeal
the decision of the Township Manager within seven days to the Township
Council, who shall be required to hold a hearing to determine the
reasonableness of the Manager's decision within 30 days after
receipt of notice of appeal.

a.
Containers shall be provided by the owner, tenant, lessee or occupant
of the premises. Refuse contains shall be maintained in a clean, safe
and good condition. Any container that does not conform to the provisions
of this section or that may have ragged or sharp edges or any other
defect liable to hamper or injure the person collecting the contents
thereof shall not be utilized. The collector shall have the authority
to refuse collection services for failure to comply herewith.
b.
Requirements.
1.
The containers shall be of galvanized or plastic composition, shall
not exceed 30 gallons in capacity, shall be no heavier than 60 pounds
when filled, shall have a lid or cover and shall have two sturdy handles.
2.
Plastic bags not less than two mils thick not larger than 40 gallons
may be used if properly tied. Substitute containers may be used in
place of approved containers, such as another bag, water repellent
and animal repellent, treated paper garbage and refuse bag or a bag
of similar nature. These bags shall be not less than two mils thick,
not larger than 40 gallons. All bags used shall be properly tied and
secured.
c.
Wooden, cardboard, composition paper, fiber or similar containers
are specifically prohibited for use as refuse containers. The collector
may, at his election, refuse to collect refuse in such container or
remove it from site.
d.
Any garbage or refuse that emits a foul, pungent or offensive odor
shall be secured in an approved bag.
e.
Tree trimmings, hedge clippings and other such clippings or materials
need not be placed to a container, but all such items shall be cut
to length not to exceed five feet, shall not exceed 60 pounds in weight
and shall be securely tied in bundles before being deposited for collection.
f.
All garbage and refuse, intended for collection shall be placed in
an approved container.
g.
All rubbish and garbage shall be drained of excessive liquid before
placing it into a container for collection, or it must be secured
in an approved bag.

a.
No person shall place any garbage, refuse or industrial or bulky
wastes in any street, alley or other public place or upon any private
property, whether owned by such person or not, except in an approved
container; neither shall any person throw or deposit any garbage,
refuse or industrial or bulky waste in any stream or storm drain.
b.
Accumulation of refuse; failure to remove.
c.
No person shall cast, place, sweep or deposit any grass clippings,
brush, sod or other refuse upon any street, sidewalk, alley, sewer,
parkway or other public place within the Township hereafter, except
at such times as designated by the Township Manager or the Township
Council for leaf collection.
d.
All refuse and garbage placed for collection shall be placed within
the boundaries of one's own property and no less than 15 feet
from the property line.

No owner or occupant of premises shall place garbage and/or
refuse containers for collection before 6:00 p.m. of the day prior
to collection. All garbage and/or refuse containers shall be placed
at the pickup site no later than 6:00 a.m. of the day of collection.
Each owner or occupant of premises placing garbage and/or refuse for
collection shall remove all containers from the collection site during
the periods of noncollection to an area within or adjacent to the
home or building. All garbage and refuse containers shall be stored
and maintained in a manner consistent with the provisions of this
section.

a.
Bulky and industrial wastes and hazardous wastes, as defined in this
section, shall not be placed in containers for collection but shall
be disposed of by the owner at the expense of the owner or possessor
thereof.
b.
The actual producers of refuse or the owners of premises upon which
refuse is accumulated who desire personally to collect and dispose
of such refuse, and persons who desire to dispose of waste material
not included in the definition of refuse, and collectors of refuse
from outside of the Township who desire to haul over the streets of
the Township shall use a watertight vehicle provided with a tight
cover and so operated as to prevent offensive odors escaping therefrom
and refuse or waste material from being blown, dropped or spilled
therefrom.
c.
Disposal of bulky waste items, including but not limited to automobiles,
vehicles, parts of vehicles, building materials, sod, soil, concrete,
large tree limbs, tree stumps, tree trunks and commercial and industrial
wastes shall be the responsibility of the producers or owners thereof.
d.
Disposal of all garbage, refuse or rubbish, bulky and industrial
waste, hazardous waste, construction debris and any and all waste
generated by multiple-family dwellings shall be the sole responsibility
of the owners of such multiple-family dwellings.

Collections shall be made once per week in accordance with a
schedule to be determined by the Township Manager except those days
of the week which are approved employee or national holidays for which
the Manager may make appropriate pick up scheduling accommodations.

a.
Garbage and refuse collected in the Township shall be collected,
conveyed and disposed of by the collector under the supervision of
the Township Manager. The Manager shall have the authority to make
necessary and reasonable rules and regulations implementing the day
and time of collection, type and location of waste containers and
such other matters pertaining to the collection, conveyance and disposal
of refuse and other materials as he shall find necessary in the public
interest.
b.
The Township Manager is hereby authorized and directed to promulgate
rules and regulations for the disposal of bulky and industrial waste
and hazardous waste, as defined in this section, and all other waste
material not included within the definition of refuse, where such
waste material originates within the Township, such as for the collection
of large items of garbage and refuse produced by the household which
cannot be picked up during the course of regular trash collection
by the standard equipment used. Any person desiring to dispose of
such waste shall do so in accordance with such statutes, ordinances
and regulations of the State of New Jersey and the Township as established.

Any violator of any of the provisions of this section shall,
upon conviction, be subject to the General Penalty established in
Section 1-5 of this Code.

As used in this section:
All containers comprised of aluminum, metal, tin, steel or
a combination thereof which contain or formerly contained only non-aerosol
compatible substances or such other substances as have been approved
for recycling by the New Jersey Office of Recycling.
All products made of silica or sand, soda ash and limestone;
the product being transparent or translucent and being used for packaging
or bottling of substances, and all other material commonly known as
glass.
And shall be deemed to include beverage cans, containers
and materials constructed and consisting solely of aluminum.
And include paper of the type commonly referred to as newsprint
and distributed at stated intervals, usually daily or weekly, having
printed thereon news and opinions and containing advertisements and
other matters of public interest.

a.
Program established. There is hereby established a program for the
mandatory separation of used newspaper within the Township. The occupant
or owner of any building within the Township who shall place for disposal,
removal or collection of the following named item shall do so in strict
conformity within the following added regulations:

Used newspaper shall be bundled separately and received in bundles
not to exceed 50 pounds and shall not be contained in plastic bags.
c.
Collection by unauthorized person. From time of placement at the
curb by any one of the categories described herein for collection
by the Township in accordance with the terms hereof, items shall become
the property of the Township or its authorized agent. It shall be
a violation of this section for any person unauthorized by the Township
to collect or pick-up or cause to be collected or picked up any such
items. Any and each such collection in violation hereof from one or
more residences shall constitute a separate and distinct offense punishable
as hereinafter provided.

a.

b.
Method of placing used aluminum materials.

place for disposal, removal or collection of the following named item
shall do so in strict conformity within the following added regulations:

containers not exceeding 30 gallons in capacity and shall be no heavier

sturdy handles.
c.

a.
Materials to be separated. All materials set forth in subsection
18-2.1 shall be separated from other trash and newspapers and shall
be placed in containers, galvanized or plastic composition not exceeding
30 gallons or 60 pounds when filled. The containers shall have two
sturdy handles.
b.
Mandatory compliance. The recycling of used newspaper, aluminum,
metal, tin or glass or products thereof as more specifically set forth
in this section shall be mandatory and not discretionary.
