The Charter of the City of Norwich may be read in evidence from
the volume of Sessions Laws of the State of New York containing said
Charter, from a volume printed by the authority of the Common Council
or from a certified copy made by the City Clerk or from the volume
of ordinances and bylaws provided by authority of the Common Council;
and all records of the city which the city officers are required by
law to keep shall be presumptive evidence of the truth of their contents
in any court.
All ordinances, bylaws, resolutions, rules and regulations adopted
by the Common Council, and any bylaw, resolution, rule or regulation
adopted by any board or commission and approved by the Common Council,
shall be and the same are hereby made, and have the same force and
effect of a statute as if expressly prescribed in this Act.
All property, both real and personal, franchises, rights and
privileges now belonging to, held or controlled by the Village of
Norwich, and all easements, together with all of other property rights
and privileges of every name and nature now owned by or under the
control of the Village of Norwich under any general law or special
law of this state, are hereby preserved to the City of Norwich to
be owned, hold, controlled and enjoyed by the city in the same manner
and to the full extent as if this Act had not been passed.
The word "person" as used in this Act shall be construed to
include all persons, firms, corporations and associations. The term
"resolution" as used in this Act includes all motions, orders, rules,
regulations and bylaws other than ordinances. The term "streets" as
used in this Act includes highways, roads, avenues, lanes or alleys
or any section thereof which the public have a right to use. The term
"pavement" includes macadam, telford, asphalt, brick or other similar
or improved roadbeds and also curbed gutters, drains and storm sewers.
The term "his" includes the words "her" "its" or "theirs". The word
"material" shall be held to include supplies, stationery, books, tools
and furniture.
When corporations, associations or copartners are to be served
with a notice under any provision of this Act, or under direction,
of the Common Council, it shall be deemed sufficient, valid and legal
service of such notice, to serve a copy thereof upon a person to whom
a summons may be served pursuant to the provisions of the Civil Practice
Act of New York.
All resignations of any officer under this Act shall be made
to the Common Council and be subject to its acceptance.
All the powers and duties except as herein otherwise provided
which are vested in or imposed upon any board or commission of the
Village of Norwich shall, when this Act takes effect, vest in, and
be imposed upon the Common Council of the City of Norwich with full
power to carry out and execute any or all of such powers and duties.
From and after the date when this Act shall become a law, the
officers of city shall be continued in office until their respective
terms for which they were elected have expired, or their office by
other means becomes vacant.
