A. 
A Planning Board consisting of five members and one alternate member hereby is established. Appointments shall be made by the Mayor, subject to the approval of the Board of Trustees. The first member appointed shall have a term which expires at the end of the current official year and the remaining members' terms shall expire at the end of the second, third, fourth and fifth official years, respectively. At the expiration of each original appointment, the succeeding member shall be appointed for five years. The members of the Planning Board in office at the time this section takes effect shall continue in office until the end of the term for which they were appointed and their successors have been appointed, as provided in this section. All appointments to fill vacancies shall be for the unexpired term.
B. 
Any official of the Village on the Planning Board shall not, by reason of membership thereon, forfeit his right to exercise the powers, perform the duties or receive the compensation of the municipal office held by him during such membership. No more than one such member shall hold other public office in the Village.
C. 
Any members of the Planning Board may be removed by the Mayor for cause after a public hearing.
D. 
The Board of Trustees shall designate a member of the Planning Board to act as Chairman thereof.
E. 
Each member of the Planning Board shall complete, at a minimum, four hours of training each year designed to enable such members to more effectively carry out their duties, in accordance with § 7-718, Subdivision 7-a, of the Village Law.
F. 
The alternate member of the Planning Board shall serve for a term of one year and shall substitute for a member in the event such member is absent or otherwise unable to serve.
The Planning Board shall have the power and authority to:
A. 
Employ experts, clerks and a secretary and to pay for their services and expenses as may be necessary and proper, not exceeding the appropriation made therefor by the Board of Trustees.
B. 
Adopt rules and regulations in respect to the procedures before it and in respect to any subject matter over which it has jurisdiction, after a public hearing by the Board and subject to the approval of the Board of Trustees.
C. 
Prepare or change a comprehensive plan for the development of the entire Village.
D. 
Advertise and hold public hearings; review and approve, approve with modifications or disapprove plats showing lots, blocks or sites with or without streets, and to conditionally approve preliminary plats.
E. 
To make investigations, maps and reports and recommendations relating to the planning and development of the Village as it deems desirable, providing the total expense shall not exceed the appropriation for expenses.
F. 
At the discretion of the Board, to refer applications for review and recommendations to the Design Review Board where the applications involve matters relating to the design of buildings.
A. 
Any officer, department, board or bureau of the Village with the approval of the Board of Trustees or any person or persons jointly or severally aggrieved by any decision of the Planning Board may bring a proceeding to review in the manner provided by Article 78 of the Civil Practice Law and Rules in a court of record on the ground that such decision is illegal in whole or part. Such proceeding must be commenced within 30 days after the filing of the decision in the office of the Board.
B. 
Commencement of the proceeding shall "stay" proceedings upon the decision appealed from.
