A code regulating and controlling the location
and construction, alteration and operation of swimming pools, the
issuance of licenses to locate and construct, alter or operate swimming
pools, and declaring and defining certain swimming pools as nuisances
and fixing penalties for violations is hereby adopted pursuant to
N.J.S.A. 26:3-69.1 to 69.6. A copy of said code is annexed hereto
and made a part hereof without the inclusion of the text herein.

The code established and adopted by this chapter
is described and commonly known as the "Public Recreational Bathing
Code (1987)."

Three copies of the Public Recreational Bathing
Code of New Jersey (1987) have been placed on file with the Health
Officer upon the introduction of this chapter and will remain on file
with the Health Officer for use and examination by the public.
No person shall locate and construct, alter
or operate a swimming pool until licenses therefor shall have been
issued by the Board of Health.
There shall be a fee as set forth in Appendix
A, Fee Schedule at the end of Part III of the Code, for the following:
A. For the issuance of a license to locate and construct
a swimming pool.
B. For the issuance of a license to alter a swimming
pool.
C. For the issuance or renewal of a license to operate
a swimming pool.
Licenses issued for the operation of a swimming
pool shall expire annually on December 31 of each year and application
for renewal thereof shall be submitted, together with the required
fee, prior to January 1 of each year.

Licenses required by this chapter or the Public
Recreational Bathing Code may be denied or suspended by the Board
of Health for failure to comply with this chapter or the code.
The Board of Health shall afford the person
whose license to locate and construct, alter or operate has been denied
or suspended an opportunity to be heard in public hearing and following
this, to be informed of the Board's decision.
Any person who shall violate any of the provisions of this chapter shall, upon conviction, be subject to the penalties provided in §
164-14 of Chapter
164, General Provisions, Board of Health.
