The Town of Old Lyme, acting herein by authority of Chapter
98 of the Connecticut General Statutes (C.G.S.) to regulate the use
of streets and highways, hereby establishes this article concerning
the operation of motor buses and bus-type campers on certain municipal
streets.
Whenever in this article the following terms are used, they
shall have the meanings ascribed to them as herein set forth:
BUS-TYPE CAMPER
Includes all Class A and bus conversion recreational vehicles.
MOTOR BUS
Includes every motor vehicle with a seating capacity of 10
or more passengers used for transportation either for hire or privately,
except for those vehicles excepted in C.G.S. § 13b-101(1),
(2) and (3).
No motor bus or bus-type camper shall be operated at any time
on any of the following public streets: Bocce Lane, Hartford Avenue,
Martino Avenue, Portland Avenue and Swan Avenue.
An exception from the application of this article may be granted at the discretion of the First Selectman for a bus-type camper registered in the name of a property owner whose property abuts a street listed in §
161-17 above. Additionally, an exception may be granted at the discretion of the First Selectman for other special circumstances by written request to the First Selectman's Office at least 30 days in advance.
A citation for violation of this article shall be issued by
the First Selectman or his designated appointee and served either
by hand to the driver of such motor bus or by certified mail to the
address of the owner of such bus. The fine for the first violation
shall be $500. The fine for any subsequent violation with such motor
bus shall be $1,000/day. Any person issued a citation shall be entitled
to contest the citation, and all procedures in connection therewith
shall be in accordance with C.G.S. § 7-152c, Hearing Procedures
for Citations.
