As used in this article, the following terms shall have the
meanings indicated unless a different meaning clearly appears from
the context.
BUSINESS UNIT
A parcel of real estate utilized by any person or persons
for any commercial, industrial, or professional office activity or
purpose.
DWELLING UNIT
One or more rooms used for living and sleeping purposes arranged
for occupancy by one family or by one or more persons.
LANDLORD
A lessor, or person who acts as agent for the lessor, of
any business unit, dwelling unit or parcel of land located in Schuylkill
Township.
PERSON
Any individual, partnership, association, firm, or corporation.
TENANT
A person who has the use, either by himself or with others,
of a business unit, dwelling unit or parcel of land owned by a person
other than himself for a period exceeding 30 days.
Within 30 days from the effective date of this article, each
landlord shall submit to Schuylkill Township a report form supplied
by the Township which shall contain the following information:
A. A list of the business units, dwelling units, and/or parcels of land
owned by the landlord within the Township, whether occupied or not;
B. Address of each business unit, dwelling unit and/or parcel of land;
C. A brief description of each business unit, dwelling unit and/or parcel
of land;
D. Whether said business unit, dwelling unit and/or parcel of land is
inhabited or utilized by a tenant;
E. Names of the tenants utilizing the aforementioned business unit,
dwelling unit and/or parcel of land, if any.
After the effective date of this article, any person who becomes a landlord of any business unit, dwelling unit, and/or parcel of land in Schuylkill Township by agreement of sale, by deed or by any other means, shall, within 30 days thereafter, report to the Township, the information and date set forth in §
267-2 above on the said forms.
After the effective date of this article, each and every landlord
of any business unit, dwelling unit and/or parcel of land within the
Township shall report to the Township on said report form, any changes
in the use or occupancy of any business unit, dwelling unit and/or
parcel of land owned by the landlord. The reported change shall be
the name and address of the new tenants of such business units, dwelling
units and/or parcel of land, the date when such change was effected,
and the forwarding address of the old tenant or tenants, if known.
A landlord of a hotel, inn, or boardinghouse shall not be required
to report person as a "tenant" until that person has resided in that
establishment for a period exceeding 30 days. In the event that a
business unit, dwelling unit and/or parcel of land was used or utilized
by a tenant and then becomes vacant, this change shall also be reported
to the Township. All reports required by this section shall be made
within 10 days after the landlord has knowledge of the change.

Any person who violates any provision of this article shall,
upon conviction in a summary proceeding brought before a Magisterial
District Judge under the Pennsylvania Rules of Criminal Procedure,
be guilty of a summary offense and shall be punishable by a fine of
not more than $1,000, plus costs of prosecution. In default of payment
thereof, the defendant may be sentenced to imprisonment for a term
not exceeding 90 days. Each day or portion thereof that such violation
continues or is permitted to continue shall constitute a separate
offense, and each section of this chapter that is violated shall also
constitute a separate offense.
