No person owning, harboring or possessing any dog shall allow it to defecate on any common thoroughfare, sidewalk, play area, park or on any public property or on any private property without the permission of the owner of said property. The foregoing restriction shall not apply to that portion of any street lying between curblines, so long as all feces deposited by such dog shall be immediately removed and disposed of by any sanitary method.
If any term, part, provision, section, subdivision or paragraph of this article should be held unconstitutional, invalid or ineffective in whole or in part, such determination shall not be deemed to invalidate the remaining terms, parts, provisions, sections, subdivisions or paragraphs of this article.
Any person who violates any provision of this article shall, upon conviction thereof, be punished by a fine not exceeding $250 or by imprisonment for not more than 15 days, or both.
This article shall take effect upon filing with the Secretary of State of New York pursuant to § 27 of the Municipal Home Rule Law.
