Unless exempt by law or by an ordinance or contract of the Board
of Trustees, it shall be unlawful for any person or persons or corporation
to make any opening or excavation for any purpose whatever in or through
any street in this Village, except by written permit of a majority
of the Street Committee of the Village of Green Island, endorsed by
the Mayor.
The application for such permit must be in writing, signed by the
person, persons or corporation desiring to make such excavation or
by an agent duly authorized, in writing, and upon a form stating such
details as shall be prescribed by the Street Committee.
Said application must be accompanied by a bond to the Village of
Green Island executed by such applicant and by a surety or sureties
who shall be freeholders, and one of whom at least shall be worth
the sum of $500,000 over all debts and liabilities, which said bond
shall be conditioned to indemnify and save harmless the Village of
Green Island of and from all loss, cost and damage on account of the
granting of such permit and making such excavation and also to provide
for the restoration of said pavement within 30 days to its original
condition, as nearly as it may be. Such bond shall be left at the
office of the Village Clerk. A surety bond of a recognized fidelity
or surety company may accompany such application for the same amount
and under the same conditions as the bond hereinbefore stated.
Any person who shall be guilty of a violation of this article
shall, for each offense, be punished by a fine of not more than $250
or imprisonment for a term not to exceed 15 days, or both.
