The purpose of this chapter is to provide notice to the public
and the news media of the regular and special meetings of the Town
Board and other Boards of the Town of Schaghticoke (collectively referred
to as the "Town," "Board," or "Board of the Town of Schaghticoke")
at which public business is officially transacted, in compliance with
the Open Meetings Law (Public Officers Law, Article 7). Such notice
is designed to facilitate public attendance at such meetings and to
enable members of the public to observe and listen to the deliberations
and decisions of the Town.
A.
The terms, words and phrases used in this chapter shall have the
same meaning as such terms, words and phrases are defined in § 102
of the Public Officers Law.
B.
NEWS MEDIA
NOTICE
Additional terms as used in this chapter shall have the meanings
indicated:
The newspapers designated at the annual organizational meeting
of the Town Board as the official Town newspapers in which legal notices
may be published, those local radio and television stations designated
at the annual organization meeting of the Town Board and the Town
website.
Means, but shall not be limited to, written or oral information
relating to the date, time and place where a meeting is to be held.
The following locations are hereby designated as the sites where
notice of all meetings held by a Board of the Town of Schaghticoke
shall be posted:
The news media designated at the annual Town Board organizational
meeting, as from time to time modified by the Town Board, are hereby
designated as the news media that shall receive notice of the meetings
of the Town. The Town may, but need not, provide notice to additional
news outlets not designated at the organizational meeting.
A.
The Town
Clerk or Board Secretary shall be responsible for providing notice
to the public and the news media as provided in this chapter.
B.
The Town
Clerk or Board Secretary shall, upon request, whenever possible, provide
notice to any person of the date, time, and place of a meeting of
the Town, whether the request for such information is made in person,
in writing, or by telephone.
A.
The public shall be informed of meetings scheduled at least one week in advance by the posting of a notice at least 72 hours in advance of such meeting at the locations designated in § 25-3 herein.
B.
The news
media designated at the annual organizational meeting herein shall
be informed of a meeting scheduled at least one week in advance by
the providing to an officer or employee of the news media a copy of
the notice by mail, telephone, facsimile or personal delivery at least
72 hours in advance of such meeting.
C.
The Town
Clerk, Board Secretary or his/her designee shall prepare an affidavit
of service and posting to document that notice was provided and posted
as required by this section.
A.
Public notice of the time and place of a meeting scheduled less than one week in advance shall be given, to the extent practicable, to the news media and shall be conspicuously posted in the public locations designated in § 25-3 at a reasonable time prior thereto.
B.
The Town
Clerk, Board Secretary or his/her designee shall prepare an affidavit
of service and posting to document that notice was provided and posted
as required by this section.
A.
When a Board
schedules meetings in advance that are to be held at specific times
and locations and on dates, a single notice may be provided to the
public and the news media.
When the time, date, or location of a scheduled meeting is changed,
the Town Clerk or Board Secretary shall, as soon as practicable:
