Emergency parking regulations shall be declared and implemented by the Town Supervisor.
Parking shall be restricted on Town and county highways from November 1 to April 1 of the calendar year on an odd/even side of the street basis as follows:
A. 
Beginning at 7:00 a.m. on odd calendar days, parking shall be allowed only on the side of the street with oddnumbered houses to 7:00 a.m. on the following day, such that on even calendar days, parking shall be allowed only on the side of the street with even-numbered houses from 7:00 a.m. on even calendar days to 7:00 a.m. the following day.
A. 
The west side of streets running north to south and the south side of streets running east to west are hereby designated the odd side of those streets.
B. 
The east side of streets running north to south and the north side of streets running east to west are hereby designated the even side of those streets.
When any vehicle is parked on any road in violation of § 116-2 of this article, said vehicle is subject to removal by towing. All towing and storage fees and expenses shall be the responsibility of the owner of the towed vehicle.
The Highway Superintendent and the Code Enforcement Officer and their designees are hereby authorized to identify vehicles in violation of this article and to engage the services of the reputable towing agency for towing and storage of said vehicles.
The words and phrases used in this article shall, for the purpose of this article, have the meanings respectively ascribed to them by Article 1 of the Vehicle and Traffic Law of the State of New York.

The Town Board hereby authorizes a permitting system to grant property owners with frontage on Town roads permission to establish designated handicap parking spaces in the vicinity of their property. This authority is subject to the provisions of the NYS Vehicle and Traffic Law §§ 1603, 1660(a)18, 1682 and 1683(a)8.
The Town Board, in consultation with the Highway Superintendent, adopts the following requirements by which a property owner may apply for and obtain authorization to establish a handicap parking space in the vicinity of their property:
A. 
A property owner shall make a request in writing to the Town Board for establishment of a handicap parking space.
B. 
The written application shall contain, at a minimum, the following materials:
(1) 
Proof of ownership or a lease interest in the property;
(2) 
Proof that a person residing at the property has a permit issued under § 1203-a of the Vehicle and Traffic Law or a registration issued under § 404-a of the Vehicle and Traffic Law.
(3) 
A map or sketch identifying the proposed location of the handicap parking space.
(4) 
An application fee, if such fee is established in the fee schedule adopted by the Town Board.
C. 
Upon receipt of an application, the Town Board shall refer a copy of the application to the Highway Superintendent for an opinion.
D. 
The Town Board shall grant the application so long as it finds that:
(1) 
Proof of ownership or lease for the property has been supplied;
(2) 
The applicant demonstrates that a person residing at the property has a permit issued under§ 1203-a of the Vehicle and Traffic Law or a registration issued under § 404-a of the Vehicle and Traffic Law.
(3) 
The Highway Superintendent is of the opinion that the establishment of a handicap parking space will not impair or impact the functionality and utilization of the Town road.
E. 
The authorization shall be valid for a period of two years. Thereafter, the applicant shall request a renewal of the authorization, which shall include current documentation that a person residing at the property has a permit issued under § 1203-a of the Vehicle and Traffic Law or a registration issued under § 404-a of the Vehicle and Traffic Law.
F. 
The cost of the required signage and its installation shall be a charge against the Town Highway budget.
The Town Clerk shall maintain a registry of the properties and specific locations authorized to establish handicap parking spaces.
It shall be a violation for any person to stop, stand or park a vehicle in any designated handicapped parking space on a Town road unless:
A. 
The vehicle bears either a permit issued under § 1203-a of the Vehicle and Traffic Law, as amended or changed, or a registration issued under § 404-a of the Vehicle and Traffic Law, as amended or changed; and
B. 
In addition to the above, such vehicle is being used for the transportation of a severely disabled or handicapped person.
Any person who parks in spaces on a Town road marked for use by the handicapped in accordance with this section without a permit issued under § 1203-a of the Vehicle and Traffic Law or whose motor vehicle is not registered in accordance with § 404-a of the Vehicle and Traffic Law, as amended or changed, or not being used for transportation of a handicapped person or severely disabled person, shall be subject to a fine of $100 for the first offense, which shall increase to $150 if not paid within 30 days from the date a summons is issued; and a fine of $200 for the second offense occurring within a period of two years within the Town of Schaghticoke, which shall increase to $250 if not paid within 30 days from the date a summons is issued.
Nothing in this article shall effect or regulate handicap parking spaces: 1) established pursuant to the authority granted under § 1602, § 1603 or § 1660-a of the Vehicle and Traffic Law, as amended or changed; or 2) established pursuant to § 1203-c of the Vehicle and Traffic Law, as amended or changed.
