Every person who shall at public outcry offer for sale as principal
or agent, to the highest bidder on the spot, any articles of merchandise
or property shall be deemed an auctioneer.

No person shall engage in the calling of an auctioneer or conduct
a public auction room without first having obtained a permit from
the Township Clerk, and without first having filed a bond as provided
in this article, and without first having paid any license or inspection
fee provided by this Code or any other ordinance of this Township.

All applications for a permit from the Township Clerk, as required
by the preceding section, shall be made, in writing, by the person
desiring such permit and shall contain a description of the premises
sought to be used as a public auction room. The Township Clerk may
grant such permit in conformity with this article.

8-25 shall not be transferable, nor shall they be loaned or used by any other person.

No person other than a licensed auctioneer, who shall have complied
with the terms of this article, shall hold, conduct, carry on or maintain
any auction room or place for holding public auction sales, or advertise
or hold himself out to the public as an auctioneer, or conduct, carry
on or maintain any sale of goods by public auction, bona fide or otherwise.

In addition to any other penalties imposed for any violation
of any of the provisions of this article by any auctioneer or by any
other person with an auctioneer's knowledge and consent or connivance,
the license of such auctioneer shall be revoked.

Any citizen of the United States and of the state who is of
good moral character, who has been a resident of the Township for
one year continuously prior to his application therefor, may become
an auctioneer within the Township and be authorized to sell real and
personal property at public auction, if the permit mentioned in this
article has been procured, and if such person has filed a bond in
accordance with the provisions of this article for the faithful performance
of his duties. Such permit may be granted to a firm, provided that
such firm shall designate a member of such firm as such auctioneer
who shall comply with the requirements of this section.

The bond referred to in §
8-25 shall be in the sum of $5,000, payable to the Township, and shall be signed by two or more sureties, each of whom shall be worth such sum, which bond shall be approved by the Township Clerk and filed in the office of the Township Clerk.

All auctioneers shall keep a record in which they shall enter
all sales, the amount paid and the date of each sale, which book shall
be open at all times for the inspection of the Police Department and
of any person interested therein.

Any person aggrieved or damaged by an act of any auctioneer
in the Township in violation of or contrary to the provisions of this
article may have an action against such auctioneer and his bondsmen
upon his official bond.
