The purpose of this chapter is to regulate the
use or operation of recreational motor vehicles throughout the Township
of Evesham.
As used in this chapter, the following terms
shall have the meanings indicated:
RECREATIONAL MOTOR VEHICLE
Expressly includes, but shall not be limited to, minibikes,
motor scooters, go-carts, golf carts which are not in use on an existing
golf course, motorbikes, dune buggies and swamp buggies. Lawn mowers,
motorized garden vehicles, tractors and related farm or domestic vehicles
and mopeds are specifically excepted from this section.
It shall be unlawful for any person to operate
a recreational motor vehicle within the Township of Evesham under
the following circumstances:
A. On private property of another without the express
prior written consent of the owner and the occupant of said premises.
Said express written consent shall be on the person of said operator
and available for inspection upon demand by any duly authorized law
enforcement officer.
B. On any public property, including all Township-owned
premises, including but not limited to parks, ball fields, recreation
areas, streets, easements, sidewalks or areas principally used for
vehicular or pedestrian traffic or Board of Education lands, unless
said lands or a portion thereof are expressly reserved for such operation
by ordinance of the Township of Evesham.
C. In such a manner as to create loud, raucous or unnecessary
noise so as to disturb or interfere with persons in the peaceful and
quiet enjoyment of their property, premises or residence. Further,
no person shall operate a recreational motor vehicle before the hour
of 9:00 a.m. and after the hour of 8:00 p.m. prevailing time or sunset,
whichever shall first occur.
D. In a careless, reckless or negligent manner so as
to endanger the safety or property of any person.
Any person under the age of 18 who shall violate any of the provisions of this chapter shall be subject to the adjudication and disposition provisions of N.J.S.A. 2A:4-42 et seq. Further, any parent, guardian or any person having the care, custody and control of any child under the age of 18 years, who shall knowingly permit such child to operate a recreational motor vehicle, shall be in violation of this chapter. Any person of the age of 18 years or over who shall violate any provisions of this chapter shall, upon conviction, be punished as provided in Chapter
1, General Provisions, Article
I, of the Code of Evesham Township.
