No person under the age of 18 years shall be in or on any of
the streets, parks or public places of the Town of Waterford between
the hours of 10:00 p.m. and 5:00 a.m. on Sundays, Mondays, Tuesdays,
Wednesdays or Thursdays or between the hours of 11:30 p.m. and 5:00
a.m. on Fridays or Saturdays unless such person is accompanied by
a parent, guardian, relative or other person over the age of 18 authorized
to have legal care and control of such person.
A siren shall be blown 15 minutes before the designated hour
at which all children under the age of 18 years shall be off said
streets, parks or public places.
The Town Board of the Town of Waterford shall have the power
to grant extensions of this curfew to children under the age of 18
years to be in or upon the streets, parks or public places after the
designated hour to attend such functions the Board may authorize.
Appropriate passes will be issued to children granted such extensions.
These passes shall be given to the sponsor of the function, who shall
issue them to the children actually present at the function, and not
before. The passes shall state the name of the function, the sponsor,
the date and the time to which the curfew is extended. The Board shall
also have the authority to exempt from the provisions of this chapter
persons whose employment requires them to be in or upon the streets,
parks or public places after the designated hour. Such persons shall
be issued identification cards upon application to the Police Department,
indicating the name of the person to whom the card is issued, the
name of the person's employer and the hour to which the curfew shall
be extended.

The penalties for the violation of this chapter shall be as
follows:
A. Persons less than 16 years of age.
(1) In the event of any violation of the above provisions by any person
less than 16 years of age, the offending person shall be taken into
custody by the police officer involved. The police officer shall immediately
notify the parent, guardian, relative or other person over the age
of 18 authorized to have legal care and control of such person that
the offending person is in the custody of the Waterford Police Department.
The offending person will be released into the custody of the parent,
guardian, relative or other person over the age of 18 years of age
authorized to have legal care and control of such person.
(2) In the event that it is alleged that the offending person is ungovernable,
habitually disobedient and/or beyond the lawful control of the parent,
guardian, relative or other person responsible for the care and control
of such person, a police officer may originate a person-in-need-of-supervision
proceeding according to the applicable provisions of the New York
State Family Court Act.
B. Persons over 16 years of age and less than 18 years of age. Any violation
of the above provisions by any person over 16 years of age and less
than 18 years of age shall be punishable by a maximum fine of $250
or by imprisonment of not more than 15 days, or both.
