No person shall operate or conduct or cause to be operated or conducted any outdoor circus, street show or carnival within the Town of Oneonta without first obtaining a permit for such showing or operation, provided that a permit will only be issued for operations in an HDD District, a B-1 District or a B-2 District.
As used in this chapter, the following terms shall have the meanings indicated:
PERSON
Includes natural persons, corporations, partnerships, joint-stock companies, associations or any legal entity of any kind capable of being sued.
A. 
Any person desiring to procure a permit as herein provided shall file with the Town Clerk a written application therefor upon a blank form prepared and provided by the town. Such application shall state the name and address of the applicant and owner of such circus, carnival or show, and if a corporation, the state of incorporation and the place of meeting of the board of directors thereof. Such application shall also state the route over which said circus, carnival or show is to be transported to the grounds over the streets and highways.
B. 
The applicant shall also state that it is in compliance with all federal and state rules, regulations, statutes, ordinances and laws. The applicant shall acknowledge that this permit, if granted, may be withdrawn by the Town of Oneonta upon violation of any such applicable federal or state rules, regulations, statutes, ordinances and laws.

A. 
Upon filing of the application and upon the payment of a fee to the Town Clerk of $100 or such other amount as may be established by resolution of the Town Board, the Town Clerk may issue a permit for such showing.
B. 
The permit may be withdrawn by the Town Board upon violation by the applicant of any federal, state or local law, regulation or law pertaining thereto.

The Town Clerk shall prepare and keep a record of permits issued under this chapter and shall keep copies thereof in the Clerk's office as a permanent record.
This chapter does not apply to church carnivals or recognized chautauquas or to any performance by any school, church or agricultural society.

Any person committing an offense against any of the provisions of this chapter shall be guilty of a violation under the Penal Law and, upon conviction thereof, shall be punishable by a fine not to exceed $250 or by imprisonment for not more than 15 days, or by both a fine and imprisonment.
