There is hereby established, as a department of the City government,
a Department of Public Works and Engineering. The department head
of the Department of Public Works and Engineering shall be the Director
of Public Works, who shall also be the City Engineer.

A. The Director of the Department of Public Works and Engineering may
also hold the position of City Engineer; provided, however, that if
the Director also holds the position of City Engineer, the salary
to be paid to the Director of the Department of Public Works and Engineering
shall be for services performed as Director, and no salary shall be
paid by reason of such person's service or position as City Engineer.
B. The City Engineer shall be a licensed professional engineer of the
state of New Jersey.
C. As required by law, the term of office of the City Engineer shall
be three years; provided, however, that if the position of City Engineer
shall at any time be vacant the City Manager may appoint an acting
City Engineer, who shall serve in that capacity at the pleasure of
the City Manager, without a fixed term of office.

A. The Planning Office shall be an office within the Office of the City
Engineer.
B. The head of the Planning Office shall be the City Planner.
C. The functions and duties of the Planning Office shall include the
providing of planning services required by the City government; providing
advice and assistance to the City Council, the City Manager and other
City departments, offices, boards and agencies, including the Board
of Adjustment and the Planning Board, with respect to any question
or issue involving planning matters; the providing of administrative
services to the Planning Board; and providing such additional related
duties and functions as may be described by the City Manager or the
Director of Public Works.

A. Within the Department of Public Works and Engineering there shall
be a Division of Vehicle Maintenance.
B. The head of the Division of Vehicle Maintenance shall be the Manager
of Central Maintenance.
C. The Division of Vehicle Maintenance shall perform required maintenance,
repair and related work involving motor vehicles and other equipment
owned or used by the City and such other duties and functions as may
be prescribed by the Director of Public Works and Engineering or the
City Manager.
The positions of superintendent and supervisor shall also be
supervisory positions within the Department of Public Works and Engineering,
with each such position to have the following functions and duties:
A. Superintendents.
(1) The Director of the Department of Public Works and Engineering or
the Manager of Operations may divide responsibility for the operations
of specific functions of the Department among the superintendents.
(2) The superintendents shall be responsible to and work under the general
supervision and control of the Manager of Operations.
(3) The superintendents shall have overall responsibility for and exercise
general supervision over all employees assigned to any of the functions
for which they are assigned responsibility.
(4) The superintendents shall also perform such other duties as may be
assigned to them by the Manager of Operations, the Director, or the
City Manager.
B. Supervisors.
(1) The supervisors shall be working supervisors and shall be responsible
to and work under the general supervision and control of the superintendents
and the Manager of Operations, and the superintendents, the Manager
of Operations or the Director shall divide and assign responsibilities
among them.
(2) The duties of the supervisors shall include direct supervision and
responsibility for, as well as performance of required work involving
any function for which they are assigned responsibility, and the performance
of such other functions and duties as may be assigned to them by the
superintendents, the Director, or the City Manager.
Except as may otherwise be prescribed by ordinance, or except
as may be otherwise prescribed in any applicable collective negotiation
agreement, employees within the Department of Public Works who are
in the classified service of the City may be assigned, by the Director
or by the Manager of Operations or by a superintendent designated
as labor pool coordinator, to the labor pool, and those employees
so assigned to the labor pool shall perform such job, work or function
designated by the Director or the Manager of Operations or the superintendent
designated as labor pool coordinator, provided that such employee
is capable of performing same; provided, further, that if any employee
is assigned to perform the duties of an employee in a higher paying
classification, then for such work he shall be paid at that higher
rate of pay; and provided, further, that in no event shall an employee
be paid at a rate of pay lower than that applicable to his classification,
notwithstanding that he may be performing duties of an employee in
a lower paying classification.

A. Within the Department of Public Works and Engineering, there shall
be a Division of Community Development.
B. The head of the Division of Community Development shall be the Community
Development Officer.
C. The functions and duties of the Division of Community Development
shall be to investigate, seek out and, subject to approval of the
Director of Public Works, the City Manager or City Council, apply
for financial grants or other forms of financial assistance programs
of benefit to the City government, or to the City, from or through
the federal or state government, or any other governmental entity
or agency or any public, quasi-public or private foundation or other
source; to advise the Director of Public Works, the City Manager and
the City Council of such grant or assistance programs which may be
available and beneficial to the City; to assist in the provision of
and upgrading of housing for low- and moderate-income persons and
families; to foster and assist in the development and implementation
of programs of commercial improvement and development in the City;
and to provide administrative services respecting functions and duties
which may be related to the foregoing, as may be prescribed by the
Director of Public Works or the City Manager.
