It is hereby determined that:
A. 
The notice of hearing was duly published and posted as required by law and is otherwise sufficient;
B. 
All property and property owners within the proposed district are benefited thereby;
C. 
All property and property owners benefited are included within the limits of the proposed district;
D. 
The establishment of this district is in the public interest;
E. 
The establishment of this district was placed on the ballot at the general election held during November 2003 and was adopted by a majority vote which answered in the affirmative the question: "Shall the Town of Coxsackie create an Ambulance District, which district shall encompass the entire Town, and which Ambulance District shall have authority to provide basic and/or advanced ambulance services on a Town-wide basis, the cost of which may be borne by the residents within the Town."
It is further determined and resolved that the district, encompassing all of the lands of the Town, including the Village of Coxsackie, as shown on the map of the entire Town, plan and report be approved, that the requested Ambulance District be established, and that the necessary expenditures be made upon the required funds being made available and provided for.
This district shall be known as the "Coxsackie Ambulance District in the Town of Coxsackie and the Village of Coxsackie" and shall be bounded and described as follows: which district shall encompass the entire Town of Coxsackie, including all of the Village of Coxsackie, both within the County of Greene, State of New York. The said district boundaries to be coterminous with the boundaries of the Town of Coxsackie, including the entire territory of the Village of Coxsackie
The proposed improvement, including annual contract costs for advanced life support ambulance service and such other related ancillary activities as may be necessary to effectively provide such services, legal and consultation fees, and all other expenses, shall be financed as may be determined by the Town Board, at an annual cost not to exceed $350,000, the cost of the Coxsackie Ambulance District to be assessed by the Town Board in as close a proportion to the benefit to which each lot or parcel will derive from the improvement as is possible. The cost may also be supplemented by billing patients who are rendered service by the ambulance service(s).
This chapter is subject to permissive referendum as provided in Town Law § 209-e, in the manner provided in Article 7 of the Town Law and pursuant to Municipal Home Rule Law § 24.
