A.
The Village Board of the Village of Nissequogue ("the Village Board")
hereby declares and finds it to be in the public interest to regulate
certain exterior lighting within the Village and to prohibit the maintenance
of certain types of illumination that would either create a danger
to vehicular traffic or constitute a nuisance to the quiet enjoyment
of neighboring properties.
B.
The Village Board finds that prohibiting the maintenance of certain
types of exterior lighting, as defined herein, is necessary under
the police power granted to the Village for the public good and that
the maintaining of prohibited types of such lighting will constitute
a danger or nuisance.
The following terms, as used in this chapter, shall have the
following meanings, unless the context requires or indicates a different
meaning:
Includes incandescent spot floodlights with bulbs in excess
of 100 watts and any quartz halogen, mercury or sodium vapor light
or other lighting devices providing extraordinarily bright illumination.
A.
No exterior lighting shall be so operated as to be a nuisance.
B.
No exterior lights of any kind or nature shall shine directly on
or at neighboring property or a public or private road, thereby constituting
a nuisance. It shall be within the discretion of the Village Board
to determine if lights create a nuisance within the meaning of this
section.
A.
All exterior lighting on premises located within the Village of Nissequogue,
whether it be floodlighting or otherwise, shall be shut off not later
than 11:00 p.m., prevailing time, if requested by the occupant of
the abutting premises or upon the direction of the Police Department
of the Village of Nissequogue.
B.
All exterior lighting shall be steady in nature, not flashing, moving
or changing in brilliance, color or intensity, provided that such
restriction shall not apply to temporary decorative lighting placed
on a residential premises during Christmas or other recognized holiday
seasons.
C.
A string or strings of lights which are visible from the exterior
of the premises are prohibited, provided that such restriction shall
not apply to temporary decorative lighting placed on residential premises
during Christmas or other recognized holiday seasons.
This chapter shall not apply to any person or entity receiving
a special permit from the Village Board to maintain either permanent
or temporary lighting for any extraordinary purpose or need, either
private or public, as the Village Board may determine. Such special
permit may be issued, provided that the purposes intended do not violate
the spirit and intent of this chapter. The duration of such special
permit shall be determined by the Village Board.
Any person or entity found in violation of any section of this
chapter may be fined an amount not to exceed $500.
