The Nissequogue River, Smithtown Bay and Stony Brook Harbor are the locations of important recreational resources; they also contain extensive fish and wildlife habitats of local and statewide significance. The Village of Nissequogue, with the Village of Head-of-the-Harbor, has entered into a Local Waterfront Revitalization Program under the New York State Coastal Management Program, which includes a commitment to protect and conserve the natural resources of the Nissequogue River, Smithtown Bay and Stony Brook Harbor. The discharge of wastes into waters from vessels or from the shore or the disposal into the waters of any kind of refuse is inimical to the well being of the Nissequogue River, Smithtown Bay and Stony Brook Harbor and their continued existence as a valuable resource.
As used in this chapter, the following terms shall have the meanings indicated:
REFUSE
Disposable materials not included below, such as vegetable matter, garbage, wood and lumber and the like.
WASTE
Includes any disposable materials, including sanitary wastes, plastics, paper, metals, chemicals, petroleum products, medical wastes, toxic wastes and the like.
All regulations apply within the boundaries of the Village of Nissequogue.
A. 
The discharge into the waters of the Nissequogue River, Smithtown Bay or Stony Brook Harbor of any waste or refuse is prohibited.
B. 
The depositing of oil, gasoline or any petroleum products from any marine engine into the waters of the Nissequogue River, Smithtown Bay or Stony Brook Harbor is prohibited.

Any discharge or dumping of any waste or refuse into the waters of the Nissequogue River, Smithtown Bay or Stony Brook Harbor from any location within the Village of Nissequogue is prohibited.

Penalties for violation of the above regulations shall be a fine of $250.
