Unanchored fuel tanks and smaller dumpsters can be easily moved
by floodwaters. Anchoring such structures advances the public safety
and protects the environment by preventing such structures from being
swept away by floodwaters where they can damage houses and buildings
and/or cause fuel spills. All aboveground fuel tanks and dumpsters
as designated below shall be subject to the anchoring and licensing
provisions of this article to minimize the potential for such damage.

The owner of any property in an area of special flood hazard, as defined in §
88-59 of the Code of the Town of Clinton, shall obtain a license from the Town for any aboveground fuel tank or any dumpster of 10 cubic yards or less in volume that is located on the property. Licenses shall be available from the construction office free of charge. Each license shall include a sticker to be affixed in a prominent location to the fuel tank or dumpster and a diagram or diagrams for anchoring fuel tanks and dumpsters.

It shall be a violation for failure to comply with any part
of this article. The Town of Clinton Code Enforcement Officer, Zoning
Official or Police Department shall enforce the provisions of this
article. Any person who shall violate the provisions of this article
shall, upon conviction, be punished by a fine not to exceed $2,000,
by imprisonment for a term not to exceed 90 days or by a period of
community service not to exceed 90 days, or any combination thereof.
