No person, firm or corporation shall keep any hog, cattle, goat
or sheep or any hive of bees at any place within the Borough of Masontown.
No person, firm or corporation shall keep any horse or horses
at any place within the borough, except with special permission from
the Board of Health or such other department or person designated
by Council.
A. Such permission shall be granted only on the following conditions:
(1) The place where such horse or horses are proposed to be kept shall
be so located and the stable to be provided is such that no nuisance
shall result therefrom.
(2) No stable shall be located within 50 feet of any dwelling house or
within 30 feet of any street.
(3) Every stable shall be kept in a sanitary condition and free from
unpleasant odors and conditions contributing to the breeding of flies.
(4) Manure and filth shall not be permitted to accumulate to the annoyance
of any resident of the vicinity or person traveling thereby.
B. Any permission granted by the Board of Health or such other department
or person designated by Council under this section may be revoked
thereby at any time when any of the conditions of this section are
not complied with.

No person, firm or corporation shall keep any chickens or other
fowl at any place within the Borough of Masontown, including all exotic
animals, with the exception of birds such as parrots, parakeets, canaries,
etc., that are housed inside.
No person shall bury any horse, cattle, sheep or swine at any
place within the limits of the borough. Any person burying any other
dead animal within the limits of the borough shall be required to
bury the same not less than three feet below the surface of the ground.

Any person, firm or corporation who or which shall violate any
of the provisions of this article shall, upon conviction thereof,
by punishable by a fine of not more than $300 and costs of such proceedings
or, upon default of payment of such fine and costs, by imprisonment
in the county jail for a term of not more than 30 days; provided,
however, that if the District Justice determines that the defendant
is without the financial means to pay the fines and costs immediately
or in a single remittance, such defendant shall be permitted to pay
the fines or costs in installments and over such periods of time as
the District Justice deems to be just.
