A. 
Volume 6 NYCRR 617.14(g) of the regulations relating to Article 8 of the Environmental Conservation Law of New York (SEQRA) allows a local agency to designate a specific geographical area or areas within its boundaries as "critical environmental areas."
B. 
To be designated as a critical environmental area (CEA), an area must have exceptional or unique characteristics involving one or more of the following:
(1) 
A benefit or threat to human health;
(2) 
A natural setting (e.g., fish and wildlife habitat, forest and vegetation, open space and areas of important aesthetic or scenic quality);
(3) 
Agricultural, social, cultural, historic, archaeological, recreational, or education values; or
(4) 
An inherent ecological, geological or hydrological sensitivity to change that may be adversely affected by any change.
C. 
The Town Board of the Town of Cazenovia (Town Board) believes that certain geographical areas within the Town of Cazenovia contain unique natural resources that deserve designation as CEAs.
D. 
The following areas are so acknowledged to possess such attributes.
E. 
The above-described CEAs are valued for their aesthetic quality, the wildlife they support, and the recreational opportunities afforded and as such deserve protection from development that may potentially pose a threat to the special characteristics thereof.
F. 
The purpose of such designation is to protect wetlands, flood-prone areas and areas critical to the protection of water supplies and the quality of Cazenovia Lake, the lake watershed and streams, as well as to provide recreational amenities and enhance the aesthetic quality of the community.
G. 
The boundaries of the CEA are shown on the map titled "Town of Cazenovia Critical Environmental Areas," as prepared by the Madison County Planning Department.[1]

The Town Board of the Town of Cazenovia hereby determines that it is appropriate and in the best interests of the citizens of the Town of Cazenovia to designate the following areas as CEAs, as shown on the attached map,[1] in the Town of Cazenovia pursuant to 6 NYCRR 617.14 and, therefore, hereby designates the following areas as CEAs for the following reasons.

The following reasons support the designation of CEAs:
A. 
The aesthetic qualities, wildlife, and recreational opportunities afforded by the preservation of these identified proposed CEAs will protect the areas from development that may pose a threat to the special characteristics thereof.
B. 
The designation of these areas as critical environmental areas shall serve to protect and preserve these environmentally sensitive areas.
C. 
Designation of these areas will protect wetlands, flood-prone areas and areas critical to the protection of water supplies and the quality of Cazenovia Lake, the lake watershed and streams, as well as provide recreational amenities and enhance the aesthetic quality of the community.
The Town Attorney is hereby directed to provide a copy of this determination to the New York State Department of Environmental Conservation and to file all necessary paperwork in support of this action.
The following areas are designated as critical environmental areas:

Village Wellhead Protection CEA
Southeastern portion of the center of the Town and Village of Cazenovia
The area contains and protects the aquifer for portions of the Town and Village of Cazenovia, and the water supply benefits human health as a major source of potable water to Town and village residents.
Cazenovia Lake and Cazenovia Lake Shoreline Buffer CEA (Cazenovia Lake 20' CEA)
The entirety of Cazenovia Lake and 20-foot shoreline buffer encompassing the entirety of the Lake
The Lake and its 20-foot shoreline corridor provide protected habitats to fish and wildlife, lakeside vegetation and residential importance.
Chittenango Creek 20' CEA
Chittenango Creek and a 20-foot buffer from the edge of each side of the Creek
The Creek and its 20-foot corridor are resources to fish and wildlife and recreation.
