Trucks over four tons gross weight are excluded from the streets or parts of streets described in Schedule V attached to and made a part of this chapter (see §
307-54), except for the pick up and delivery of materials.
The streets or parts of streets described in Schedule VI attached to and made a part of this chapter (see §
307-55) are hereby designated as one-way streets in the direction indicated.
Pursuant to the provisions of N.J.S.A. 39:4-140, the streets or parts of streets described in Schedule VII attached to and made a part of this chapter are hereby designated as through streets (see §
307-57). Stop signs shall be installed on the near right side of each street intersecting the through street, except where YIELD RIGHT OF WAY signs are provided for in the designation.
Pursuant to the provisions of N.J.S.A. 39:4-140, the intersections
described in Schedule VIII attached to and made a part of this chapter
are hereby designated as stop intersections. STOP signs shall be installed
as provided therein.
Pursuant to the provisions of N.J.S.A. 39:4-140, the intersections
described in Schedule IX attached to and made a part of this chapter
are hereby designated as yield intersections. YIELD RIGHT OF WAY signs
shall be installed as provided therein.
The locations described in Schedule XI attached to and made a part of this chapter are hereby designated as taxi stands (see §
307-61).

A. Definitions. For the purpose of this section, the following terms,
phrases, words, and their derivations shall have the meanings stated
herein unless their use in the text of this section clearly demonstrates
a different meaning. The word "shall" is always mandatory and not
merely directory.
ENGINE BRAKING
The use or operation of any mechanical exhaust device designed
to aid in the braking, decompression or deceleration of any motor
vehicle which results in the excessive, loud, unusual or explosive
noise from such vehicle.
B. Prohibition. It shall be unlawful for the driver of any motor vehicle
to use or operate or cause to be used or operated, at any time and
on any road within the Town of Newton, any mechanical exhaust or decompression
device which results in the practice known as "engine braking."
C. Exceptions to prohibition. The provisions of this section shall not
apply to noise caused by the application of engine braking, if necessary
for the health, safety and welfare of the community, or noise created
by emergency vehicles for emergency purposes. These items are exempt
from the provisions of this section.
D. Posting signs. The Town of Newton is hereby authorized and directed
to post signs at reasonable locations within the Town indicating the
prohibition of engine braking.
E. Enforcement. The Town Manager shall enforce the provisions of this
section through the Chief of Police and the Police Department who
will be trained in distinguishing engine braking noise from normal
engine or braking noises. It shall be unlawful for any reason to violate
any part of this section adopted by the Newton Town Council.
F. Violations and penalties. Any person who violates this section shall
be subject to a fine as follows:

G. Severability. It is the intention of the Town Council that every
provision of this section shall be considered separable and the invalidity
of any article, clause or provision of this section shall not affect
the validity of any other portion of this section or this chapter.

A. All traffic control signal installations in the Town of Newton shall
be in accordance with the provisions of the Manual on Uniform Traffic
Control Devices and New Jersey Motor Vehicle and Traffic law, N.J.S.A.
39:4-105 et seq., in effect at the time of installation.
B. Traffic control signals shall be installed and operated by the Town
of Newton at the following intersections:

A. Definitions. As used in this section, the following terms shall have
the meanings indicated:
INOPERABLE MOTOR VEHICLE
Any motor vehicle that is damaged and/or missing critical
components, such as, but not limited to, the engine, transmission,
wheels, tires and/or any other mechanical or automotive defect which
renders the vehicle mechanically inoperative for lawful use on a public
roadway or incapable of being moved under its own power; and any motor
vehicle without a currently valid registration or license plate.
MAJOR DISASSEMBLY AND DISREPAIR
Shall include, but not be limited to, any of the following
common conditions of a vehicle: missing tire(s); vehicle on blocks,
jack stands or similar supports; missing windshield; missing engine,
transmission, alternator or generator, battery, axle, chassis or brakes;
missing door(s); missing steering wheel; and/or broken or missing
driveshaft.
MOTOR VEHICLE
Includes all automobiles, motor vehicles, and/or any other
vehicles in any manner subject to Title 39 of the New Jersey Statutes.
UNREGISTERED
Any motor vehicle that is not currently registered with a
state motor vehicle division or department.
B. Except as otherwise provided in §
307-17.3D below, any unregistered motor vehicle and/or inoperable registered motor vehicle and/or any motor vehicle in a state of major disassembly and disrepair, shall not be parked, kept, or stored outside on any public street, including any part or parts thereof, for more than 10 calendar days.
C. At no time shall any vehicle of any type undergo major overhauling,
including, but not limited to, bodywork, substantial repair and/or
restoration, on or about any public street, public parking lot, public
parking spaces, or public parks or thoroughfare.
D. Covering an inoperable motor vehicle or an unregistered motor vehicle
or a motor vehicle with major disassembly and disrepair is parked,
kept or stored on or in a public street, public parking lot, public
parking space, or public park or thoroughfare with a tarpaulin, cloth,
canvas, or similar covering does not satisfy the requirements of this
section.
E. At no time shall any vehicle of any type undergo major repairs on
or in any public street, public parking lot, public parking space,
or public park or thoroughfare, unless the vehicle is disabled due
to a mechanical emergency, such as a flat tire, dead battery and/or
overheated radiator, and for purposes of enabling the vehicle to be
removed from the public street, public parking lot, public parking
space, or public park. In no case shall any vehicle which is disabled
due to a mechanical emergency remain on the public street, public
parking lot, public parking space, or public park for more than 24
consecutive hours. Failure to comply with same shall cause the provisions
of this section to be immediately applied.
F. Painting of motor vehicles on or in a public street, public parking
lot, public parking space, or public park or thoroughfare is prohibited.
G. Violations and penalties. Any person who violates this section shall
be subject to a fine as follows:

Second and subsequent offenses: $500.
H. In addition to such penalties herein provided, an inoperable motor
vehicle, an unregistered motor vehicle and/or a vehicle in a state
of major disassembly or disrepair which is stored, maintained or parked
in violation of this section may be abated and/or removed by the Town
of Newton Code Enforcement Director or their designee in accordance
with such procedures made and provided in such cases.
I. For every day a violation exists/occurs as per these provisions of the Town Code, beyond the first offense notice, the provisions of §
307-17.3G(2) shall apply.
