It shall be unlawful for any person or firm to erect any fence or wall around any property within the corporate limits of the Village of Sloan without a permit granted by the Code Enforcement Officer.

A. 

No fence for which a permit is required under this chapter shall be more than six feet in height at the rear and sides of homes and buildings.

B. 

No solid fence for which a permit is required under this chapter shall be more then three feet in height in any front yard area nor closer than three feet adjacent to any sidewalk or prospective sidewalk; a transparent wire or chain-link fence can be erected not to exceed four feet in height.

C. 

Commercial fences shall be of reasonable height and within the discretion of the Code Enforcement Officer for the purpose of protecting the aesthetic appearance of the Village in general and, in particular, for the purpose of protecting the residential neighbors.

D. 

Fences shall be a minimum of three feet along parallel lines from any structure, accessory structure or another fence.

A fence, wall or similar structure unduly shutting off light or air or which may cause a nuisance, a fire hazard or a dangerous condition is prohibited.

Fencing and barriers for swimming pools are regulated by the provisions of the New York State Uniform Fire Prevention and Building Code.

No hedge fence or fence of shrubs on any premises shall be permitted to grow to a height of more than three feet in any front yard area nor nearer than three feet adjacent to any sidewalk or any prospective sidewalk.

A. 

No sign, fence, wall, hedge, shrub or tree foliage which obstructs vision at elevations between three and seven feet above street level shall be placed or maintained within the triangular area formed by two intersecting curblines in a line connecting points on such curblines 30 feet distant from their point of intersection. This shall not apply to any necessary retaining wall.

B. 

In addition to the foregoing, the Code Enforcement Officer shall have the authority to direct the removal, trimming or modification of any shrubs, bushes, plants, trees, flowers or other vegetation, fence, wall, hedge or other structure on private or public property wherever the same shall interfere with adequate visibility at street intersections or curves for operators of motor vehicles. Any person who shall refuse or neglect to comply with the direction of the Code Enforcement Officer shall be guilty of a violation.

Any person, firm or corporation who violates, disobeys, neglects or refuses to comply or who resists enforcement of any provisions of this chapter shall be guilty of an offense and, upon the conviction thereof, shall be subject to a fine not to exceed $250 or imprisonment for a term not to exceed 15 days, or both. Each day a violation is continued shall be deemed a separate offense.
