Any dealer in secondhand articles of any class who shall operate
his business and store his stock wholly within a building of a permanent
and substantial nature, which building complies with the requirements
of state, federal and local labor laws, rules and regulations and
complies with the requirements of public health statutes, rules, regulations
or codes promulgated by state or local authorities and any legally
existing fire protection and prevention laws, rules and regulations
applicable, shall be exempted from the provisions of this chapter
as to other enclosures and as to setback from street and property
lines. This provision does not relieve or excuse any noncompliance
with or violation of the Zoning Law of the Village of Sloan.
Every junkyard and every automobile junkyard or automobile wrecking
yard shall be entirely enclosed by a barrier, fence or hedge located
so as to meet the setback requirements of the Village of Sloan Zoning
Law and § 136 of the General Municipal Law, except
that, where a valid nonconforming use exists, the setback shall be
at least 50 feet from any highway and a sufficient distance from the
boundary lines of abutting owners so that the owner of said barrier,
fence or hedge may maintain the same, but not less than 15 feet. Such
barrier, fence or hedge shall be provided with a gate or gates which
shall be kept closed when not in use. The area outside said barrier,
fence or hedge shall be kept clear and free from weeds, brush, rubbish
and flammable materials. In the clear area between the barrier, fence
or hedge and any highway, no merchandise for sale shall be displayed,
and this area shall be made available for off-street parking as the
needs of the occupancy may require. Any automobile, truck, tractor,
trailer or other automotive machinery or equipment brought to the
place of business which shall be equipped with a tank for gasoline
or oil shall have all gasoline or oil removed from the tank before
it shall be placed upon the storage lot.
All material stored and kept for sale on a junkyard and on an
automobile junkyard or automobile wrecking yard shall be stored in
an orderly manner, and no materials shall be stacked to a height greater
than six feet and shall be arranged to provide aisles or passageways
between stacks.
Every person who shall conduct, engage or assist in the cutting
of metal for junk by blowtorch or any similar device shall be equipped
with all safety devices to comply with the provisions of the State
Labor Law and all rules, regulations and orders of the Department
of Labor and Chapter IV of the Air Pollution Control Rules.
No secondhand automobile dealer shall store upon his lot or
keep thereon or offer for sale thereon any used automobiles, trucks,
tractors, trailers or other automotive machinery or equipment which
is not in usable condition but may keep a shop for conditioning and
repair thereof in the rear of the place used for showing such automobiles
or in a permanent building on the lot which is in part used as office
or sales room.
All dealers in secondhand containers, except such as keep their
stock wholly within a permanent building as above provided, shall
comply with the same requirements as set forth in the foregoing sections
of this chapter for yard requirements of a lot for used or secondhand
building materials.
