§ 15-201 Maximum Speed Limits Established on Certain Streets.

Maximum speed limits are established on portions of specified streets, as follows, and it shall be unlawful for any person to drive a vehicle on any part of a street where a maximum speed limit applies at a higher speed than the maximum prescribed for that part of the street:

Any person who violates any provision of this Section shall, upon conviction, be sentenced to pay a fine of $35 and costs. Any person exceeding the maximum speed limit by more than five miles per hour shall pay an additional fine of $2 per mile for each mile in excess of five miles per hour over the maximum speed limit.

§ 15-202 Maximum Speed Limits Established on Certain Bridges and Elevated Structures.

Maximum speed limits are established, as follows, on certain bridges and elevated structures, and it shall be unlawful for any person to drive a vehicle on any such bridge or elevated structure at a higher speed than the maximum prescribed for that bridge or elevated structure:

§ 15-203 Maximum Speed Limits Established for Certain Vehicles on Hazardous Grades.

The following are declared to be hazardous grades and, upon any such hazardous grade, no person shall drive a vehicle, having a gross weight in excess of that referred to for that grade, in the direction stated for that grade, at a speed in excess of that established in this Section for that grade, and, if so stated for a particular grade, the driver of every such vehicle shall stop the vehicle before proceeding downhill:

Any person who violates any provision of this Section shall, upon conviction, be sentenced to pay a fine of $35 and costs. Any person exceeding the maximum speed limit by more than five miles per hour shall pay an additional fine of $2 for each mile in excess of five miles per hour over the maximum speed limit.

§ 15-204 Maximum Speed Limits Established in Parks.

A speed limit of 15 miles per hour is established on all streets and roadways in the public parks maintained and operated by the Borough of Phoenixville, except in the following locations, where the lower maximums, as specified, shall apply:

§ 15-205 Traffic Signals at Certain Locations.

At the following locations, traffic signals as indicated below shall be erected (or are ratified if previously erected), and traffic at those locations shall be directed by those signals:

Any driver of a vehicle who disobeys the directions of any traffic signal shall, upon conviction, be sentenced to pay a fine of $25 and costs.

§ 15-206 Intersections Where Turn Prohibited on Red Signal.

The following are established as intersections where drivers of vehicles headed in the direction or directions indicated are prohibited from making a right turn (or a left turn from a one-way street into another one-way street) on a steady red signal:

§ 15-207 One-Way Roadways Established.

§ 15-208 Turning at Certain Intersections Prohibited or Restricted.

It shall be unlawful for the driver of any vehicle of the type indicated traveling upon the first-named street at any of the following intersections, in the direction or directions indicated in each case, to make a left turn and/or a right turn into the second-named street, as indicated, at any time when such a turn is prohibited by this Section:

§ 15-209 Left Turns Prohibited at Certain Intersections.

Left turns are hereby prohibited at the following locations:

At the intersection of Fifth Avenue and Nutt Road for traffic proceeding in a southwesterly direction on Fifth Avenue.

For vehicles using the Bridge Street exit of the municipal parking lot located at the northeast corner of the intersection of Main Street and Bridge Street.

At the driveway entrance to the existing Renaissance Academy located on the south side of Fillmore Street approximately 100 feet west of the northwest corner of Fillmore Street and Cromby Road. A "No Left Turn 7:00 a.m. to 8:00 a.m. and 3:00 p.m. to 4:00 p.m. (School Busses Allowed)" sign shall be placed as erected.

At the intersection of Nutt Road and Valley Road for traffic proceeding in a northern direction on Valley Road.

Any person who violates any provision of this Section shall, upon conviction, be sentenced to pay a fine of $25 and costs.

§ 15-210 U-Turns Prohibited at Certain Locations.

It shall be unlawful for the driver of any vehicle traveling upon any of the following portions of streets, in the direction or directions indicated for that street, to make a U-turn:

§ 15-211 No Drop Off or Pick Up Zones Established.

The following are established as no drop off or pick up zones, and it shall be unlawful for the driver of any vehicle from picking up and dropping off passengers in any no drop off or pick up zone:

§ 15-212 Through Highways Established.

The following highways are established as through highways, thus authorizing stop or yield signs to be erected facing traffic approaching every intersection with the through highway except for those intersections with traffic signals, or with exceptions or modifications as indicated below. Every driver of a vehicle approaching a stop or yield sign authorized by this Section shall stop the vehicle or yield right-of-way as required by 75 Pa.C.S.A. §§ 3323(b), 3323(c) of the Vehicle Code, as the case may be, and shall not proceed into or across the through highway until he has followed all applicable requirements of that Section of the law:

§ 15-213 Stop Intersections Established.

The following intersections (in addition to intersections with the through highways established by § 15-212) are established as stop intersections, and official stop signs shall be erected (or are ratified if previously erected) in such a position as to face traffic approaching the second-named street (the intersecting or through street) on the first-named street (the stop street) in the direction or directions indicated for that intersection. Every driver of a vehicle approaching the intersection on the first-named or stop street, in the direction indicated in each case, shall stop the vehicle as required by the Vehicle Code, 75 Pa.C.S.A. § 3323(b), and shall not proceed into or across the second-named or intersecting or through street until he has followed all applicable requirements of that section of the law.

§ 15-214 Yield Intersections Established.

[Ord. 2118, 4/15/2008]

The following intersections (in addition to intersections with the through highways established by § 212) are established as yield intersections, and official yield signs shall be erected (or are ratified if previously erected) in such a position as to face traffic approaching the second-named street (the through street) on the first-named street (the yield street) in the direction or directions indicated for that intersection. Every driver of a vehicle approaching the intersection on the first-named or yield street, in the direction indicated in each case, shall slow down or stop the vehicle as required by 75 Pa.C.S.A. § 3323(c) of the Vehicle Code, and then yield the right-of-way as required by that subsection of the Vehicle Code.

Any person who violates any provision of this Section shall, upon conviction, be sentenced to pay a fine of $25 and costs.

§ 15-215 Vehicles on Hiking or Bike Trails Prohibited.

In any area, where public access is by right-of-way or easement (e.g., hiking or biking trails), which is limited to pedestrian walking or jogging and/or to non-motorized biking, no motor vehicle shall be operated, except for maintenance purposes only.

Any person who violates a provision of this Section shall, upon conviction, be sentenced to pay a fine of $50 and costs.

§ 15-216 Rotary Traffic Islands Established.

The following locations are designated as rotary traffic islands, and every vehicle passing around a rotary traffic island shall be driven only to the right of the island:

Any person who drives a vehicle otherwise than to the right of any rotary traffic island shall be guilty of a violation of this Section, and, upon conviction, shall be sentenced to pay a fine of $25 and costs.

§ 15-217 Play Highways Established and Authorized.

The following areas upon the streets in the Borough of Phoenixville are established as play highways:

The Mayor is authorized to designate as play highways, whenever he deems that action advisable, and for whatever period of time directed by him, any part of any street in the Borough of Phoenixville where sledding and coasting shall be permitted. That play highway shall be set apart for the purpose under the direction of the Mayor.

No person shall drive any motor vehicle upon any play highway at any time when that street shall be designated as a play highway, except in case of emergency, with special permission of the Mayor or of the police officer in charge, who shall first clear that play highway of all persons using it for the purpose for which it was set aside. Any person who violates any provision of this subsection shall, upon conviction, be sentenced to pay a fine of $25 and costs.

§ 15-218 Snowmobile Roads Designated.

The following roads and streets within the Borough of Phoenixville are designated as special snowmobile roads:

It shall be unlawful for any person to operate a snowmobile on any highway, street or road in the Borough of Phoenixville other than as provided above. Provided, nothing in this Section shall prohibit any person from operating a snowmobile on any other street in the Borough of Phoenixville:

As authorized by the Vehicle Code, 75 Pa.C.S.A. § 7721, for emergency and bridge crossings and for direct crossing of streets or two-lane highways.

For special snowmobile events where authorized in advance and the street is blocked off as provided in the Vehicle Code, 75 Pa.C.S.A. § 7723. Any person who violates any provision of this Section shall be subject to the penalties prescribed in § 7752(a) of the Vehicle Code, 75 Pa.C.S.A. § 7752(a).

§ 15-219 Motor Vehicles Not to Be Driven on Sidewalks.

No person shall operate a motor vehicle or tractor upon any sidewalk in the Borough; nor shall any person operate a motor vehicle upon or across any sidewalk except in order to gain access to or egress from a driveway or alley at such locations where the curb, if such sidewalk is curbed, shall have been properly cut down for the purpose. Any person who shall violate any provision of this Section shall, upon conviction thereof, be sentenced to pay a fine of not more than $50 and costs of prosecution, or, in default of payment of such fine and costs, to undergo imprisonment for not more than 10 days.

§ 15-220 Special Warning Signs and Striping.

A "Caution Two-Way Traffic" sign shall be installed facing Main Street on the western side of Main Street at its intersection with Morgan Street. This sign shall be affixed to the post of the stop sign installed pursuant to § 15-213 of this Part.

The two-way portion of Morgan Street immediately west of Main Street shall be striped to show the location of the two lanes, and the one-way sign on Morgan Street on the west side of Main Street shall be removed.

§ 15-221 Unlawful to Operate Motor Vehicles or Tractors on Highway Closed for Construction or Repair.

It shall be unlawful for any person to operate any vehicle or tractor upon any highway in the Borough that is under construction, resurfacing or repair, in disregard of any official sign, barricade or notice that the same is closed to vehicular traffic. Any person who shall violate any provision of this Section shall, upon conviction thereof, be sentenced to pay a fine of not more than $25 and costs of prosecution or, in default of payment of such fine and costs, to undergo imprisonment for not more than 10 days.

§ 15-222 Tractor Trailers Prohibited on Certain Streets.

It shall be illegal for tractor trailers to traverse the following streets:

§ 15-223 Through Traffic Prohibited.

No person shall operate a motor vehicle through the traffic lanes on the parking lots for any purpose other than the purpose of parking upon said lots, and the lanes reserved for traffic shall not be used as a general thoroughfare by the traveling public.

§ 15-224 Loading and Unloading Zones.

The following are hereby established as loading and unloading zones, and no vehicle shall be parked there at any time except for the purpose of loading or unloading such vehicle:

§ 15-225 Disorderly Conduct Prohibited.

[Added by Ord. No. 2021-2334, 8/10/2021]

Disorderly conduct, as defined in § 5503 of the Crimes Code, 18 Pa.C.S.A. § 5503, is hereby prohibited within the Borough of Phoenixville. A person is guilty of disorderly conduct if, with intent to cause public inconvenience, annoyance or alarm, or recklessly creating a risk thereof, he:

Operates a vehicle in any way which makes unreasonable noise.

Provided, as used in this section, the word "public" means affecting or likely to affect persons in a place to which the public or a substantial group has access. Among the places included are streets, alleys and sidewalks, transport facilities, schools, prisons, apartment houses, places of business or amusement, any neighborhood or any premises which are open to the public.

Fire Equipment and Racing Vehicles. This section does not apply to fire equipment or to racing vehicles being operated in an organized racing or competitive event conducted under a permit issued by local authorities.

Penalties for Violation. Any person who violates any provision of this section shall, upon conviction, be sentenced to pay a fine of $50, a fine of $100 for a second offense and a fine of $300 for a third and any subsequent offense, along with costs of prosecution.

Enforcement. A citation issued under this chapter shall be enforced in accordance with the procedures established by the Borough of Phoenixville Police Department for enforcement of summary violations.
