Editor's Note: This local law provided that it shall apply to assessment rolls prepared on the basis of taxable status dates occurring on or after 1-1-2002.
This article shall be entitled "Eligible Funds Veteran Exemption Adjustment Law for the Village of Fairport, New York."
This article is enacted to implement Real Property Tax Law § 458(5)(a) and (b), respectively, to:
A. 
Direct the Assessor for the Village of Fairport to adjust the amount of the eligible funds veteran exemption based upon reassessment of property within the Village of Fairport; and
B. 
To permit veterans who had converted from eligible funds veteran exemption, Real Property Tax Law § 458, to the alternative veteran exemption, Real Property Tax Law § 458-a, to change back to the eligible funds veteran exemption and obtain the benefits of the amended provision of Real Property Tax Law § 458(5).
This article is enacted pursuant to Real Property Tax Law § 458(5), as the same may be amended from time to time.
The Assessor for the Village of Fairport is hereby directed to increase or decrease the amount of eligible funds veteran exemption, as a result of a revaluation or update of assessments, by multiplying the amount of the exemption by the change in the level of assessment for the Village of Fairport, as determined by and certified by the New York State Office of Real Property Services, pursuant to the rules of said office.
At any time within one year from the effective date of this article, any property owner who previously received an exemption pursuant to Real Property Tax Law § 458, the veteran exemption, but who opted instead to receive an exemption under Real Property Tax Law § 458-a, the alternative veteran exemption, may apply to the assessor for the Village of Fairport to again receive the veteran exemption, pursuant to Real Property Tax Law § 458.
