There shall be seven members of the Library Board. A minimum of four members shall be residents of the City of Lake Geneva. One member may be a resident of the Town of Bloomfield, and one member may be a resident of the Town of Linn. There shall not be members from any other municipality, except those approved pursuant to § 43.60(3), Wis. Stats. and the person appointed by the School District Administrator. In the event there is not a member who is a resident of Bloomfield or Linn, the positions shall be filled by residents of Lake Geneva.
One of the seven members of the Library Board shall be the School District Administrator or his/her representative, to represent the local public school district.
There shall not be more than one member who is also a member of the municipal governing body serving at any one time on the Library Board.
Up to five additional members may be appointed under § 43.60(3)(a), Wis. Stats.

The members shall be appointed to the Library Board by the Mayor. The appointments shall be subject to approval by the Common Council.

The members of the Library Board shall elect a Chairman, Secretary, and Financial Secretary from amongst its members. The Library Board may elect other officers necessary or appropriate to aid in efficiently running the Board.

The members shall serve three-year terms.

Any vacancy shall be filled through the appointment procedures described above.

Members of the Library Board shall not be compensated for their services, except as follows:
(1) 
The Common Council may, at its discretion, reimburse members for their actual and necessary expenses incurred in performing duties outside the municipality, if authorized both by the Library Board and the Common Council.
(2) 
The Common Council may, at its discretion, pay members per diem, mileage, and other necessary expenses incurred in performing their duties if authorized both by the Library Board and the Common Council.

A majority of the membership of the Library Board shall constitute a quorum.

The Library Board shall have the duties and powers as set forth in W.S.A., § 43.58, including those duties and powers set forth below:
(1) 
Meeting. The Library Board shall meet at least semiannually. The Library Board may meet as necessary, or as called by the Chairman or as called by a majority of the Library Board. The City Clerk shall post all agendas for this Board. All meetings shall be at Lake Geneva Public Library.

(2) 
Duties. The Library Board shall supervise the administration of the public library and shall appoint a Librarian. The Librarian shall appoint such other assistants and employees as the Library Board deems necessary. The Librarian shall prescribe the duties and compensation of the assistants and employees.
The Library Board may employ competent persons to deliver lectures upon scientific, literary, historical, or educational subjects as outlined in W.S.A., § 43.58(5).
(3) 
Control of assets. The Library Board shall have the exclusive control:
a. 
Of the use and expenditure of all monies collected, donated, or appropriated for the library fund; and
b. 
Of the purchase of a site and the erection of a library building whenever authorized; and
c. 
Charge, and custody of all lands, buildings, money, or other property which is devised, bequeathed, given, granted to, or otherwise acquired or leased by the City of Lake Geneva for library purposes.
The library shall audit and approve all expenditures of the public library. The library shall forward bills or vouchers to the appropriate City financial officer. The vouchers shall set forth the following information:
a. 
The name of each claimant or payee,
b. 
The amount of each expenditure, and
c. 
The purpose for which it was expended.
In addition, the library shall also include a statement indicating that the expenditure has been incurred and that the Library Board has audited and approved the expenditure. The statement shall be signed by the Library Board Secretary or other designee of the Library Board. The City official shall pay then pay all appropriately submitted bills. The official may pay salaries to library employees or recurring expenses authorized by the Librarian by the respective pay day or due date. The Library Board shall audit and approve any such payment at its next regular meeting.
(4) 
Management of gifts. The Library Board may receive, manage, and dispose of gifts and donations in the following manner:
a. 
The Library Board may take title to a donation of property. The Library Board shall be deemed special trustees.
b. 
If a gift, bequest, devise, or endowment is made, the Library Board may:
Pay or transfer the donation or its proceeds to the Treasurer of the City; or

ii 
Entrust any donated funds to a public depository under ch. 34; or
iii 
Pay or transfer the donation to the Library Board's Financial Secretary. If the Library Board pays or transfers the donation to the Library Board's Financial Secretary, the same officer may invest the donation or may delegate investment authority for the donation.
In the event there is a gift made for a library building, the Library Board will retain the exclusive right to select and contract for the purchase of a site.

If the Financial Secretary holds any property belonging to the public library, the Library Board shall require a bond from the Financial Secretary to the Library Board in a sum not less than the amount of the held property and with such sureties as the Library Board requires. The bond shall be conditioned in substantially the same form as an ordinary bond required in the City.
The Financial Secretary shall make an annual report to the Library Board showing in detail the amount, investment, income and disbursements from the trust funds in the Financial Secretary's charge.

Within 60 days after the conclusion of the fiscal year of the City of Lake Geneva, the Library Board shall make a report to the Division and to the Common Council. The report shall:
(1) 
State the condition of the Library Board's trust and the various sums of money received for the use of the public library during the year.
(2) 
Separately specify amounts received from:
a. 
Appropriations;
b. 
Income of trust funds;
c. 
Rentals;
d. 
Other revenues of the public library; and
e. 
Other sources.
(3) 
State the condition of all funds in the Library Board's control.
(4) 
State in detail the disbursements on account of the public library during that fiscal year.
(5) 
Include the above-described annual Financial Secretary's report as an appendix.
(6) 
In addition, the report to the Division shall also:
a. 
Include data concerning library materials, facilities, personnel, operations, and other information as the division requests; and
b. 
Contain a statement by the Library Board indicating whether the public library system in which the library participated did or did not provide effective leadership and adequately meet the needs of the library and an explanation of why the Library Board believes so.
