The Board of Supervisors of Plumstead Township hereby creates
a Shade Tree Commission to be composed of three residents of the Township,
who shall be appointed by the Board of Supervisors and shall serve
without compensation for their terms of office and with all the rights,
powers, duties and obligations provided for by law.

Upon establishment of the Shade Tree Commission, the Township
Supervisors shall appoint one member for a term of three years, one
for a term of four years and one for a term of five years. Upon expiration
of the term of any Shade Tree Commissioner, a successor shall be appointed
by the Township Supervisors to serve for a term of five years. The
aforesaid term notwithstanding, a Board member may stay in office
until a successor qualifies or is appointed, or the Township Supervisors
may remove any member of the Commission at the pleasure of the Board
of Supervisors.

The Commission shall have exclusive custody and control of the
shade trees in the Township and is authorized to plant, remove, maintain
and protect shade trees on the public streets and highways in the
Township. The Commission may, with the approval of the Township Supervisors,
employ foresters, tree wardens or other assistants as the proper performance
of the duties devolving upon it shall require and may make, publish
and enforce regulations for the care and protection of the shade trees
of the Township. No such regulations shall be in force until they
have been approved by the Township Supervisors and until they have
been published at least twice in not more than two newspapers of general
circulation in the Township, and, if no newspapers are published in
the Township, then in such newspaper circulating in the Township.

The cost and expenses of caring for such trees after having
been planted and the expense of publishing the notice hereinbefore
provided shall be paid by the Township. The needed amount shall each
be certified by the Shade Tree Commission, to the Township Supervisors,
and shall be drawn against, as required by the Commission, in the
same manner as money appropriated for Township purposes. The Township
Supervisors, instead of levying the tax authorized under the general
tax levying powers of this act, may provide for the expense of caring
for trees already planted and of publishing the notice by appropriations
equal to the amount certified to be required by the Shade Tree Commission.

The Commission is hereby authorized to prescribe such rules
and regulations, and to impose such penalties for the violation of
same, as it may deem necessary and proper, provided that the rules
and regulations are approved by the Township Supervisors and are not
in conflict with other ordinances of the Township.

The Shade Tree Commission shall report annually to the Township
Supervisors on all transactions and expenses for the preceding fiscal
year.
