This Part shall be known as and may be cited as the "Plumstead Township's BOCA Codes, 1993."

In interpreting and applying the provisions of this Part, they shall be held to be the minimum requirements for the promotion of the public health, safety, comfort, convenience and general welfare.

That a certain document, three copies of which are on file in the Administration Office of the Township of Plumstead being marked and designated as the BOCA National Building Code, Twelfth Edition, 1993 as published by the Building Officials and Code Administrators International, Inc. is hereby adopted as the Building Code of the Township. This Building Code shall be for the control of buildings and structures as herein provided, and each and all of the regulations, provisions, penalties, conditions and terms of said BOCA National Building Code, are hereby referred to, adopted and made a part hereof as if fully set out in this Part with the additions, insertions, deletions and changes prescribed in § 5-104 of this Part.

That the following sections are hereby revised as follows:
A. 
Section 101.1 Title. Insert: "Township of Plumstead."
B. 
New § 102.2.1. Existing Structures, Change of Occupancy. Insert: "Prior to the issuance of a new certificate of occupancy all buildings and structures shall be made to comply with Chapter 10, Means of Egress and Chapter 11, Accessibility in their entirety."
C. 
Section 104.2. Appointment, of the Township Building Code, is hereby amended to read as follows:
Section 104.2. Appointment. The Code Official shall be appointed by the Township Board of Supervisors. The Code Official is an employee-at-will and may be removed or replaced by the Board of Supervisors.
D. 
Section 104.3, Organization, of the Township Building Code, is hereby amended to read as follows:
Section 104.3. Organization. The Board of Supervisors may appoint such officers, technical assistants, inspectors and other employees as shall be necessary for the administration of this code.
E. 
Section 104.4, Deputy, of the Township Building Code, is hereby revised to read as follows:
Section 104.4. Deputy. In the event that the Code Official is unable to exercise his/her duties during temporary absence or disability, the Board of Supervisors may designate an employee as Deputy Code Official who shall exercise all of the powers of the Code Official during such absence or disability.
F. 
New § 107.6.2. Site Plan, First-Floor As-Built. Insert: "A first-floor as-built site plan is to be submitted to the Township Administration Office as soon as a legitimate first floor elevation can be ascertained by field verification. The as-built site plan shall include all the information as defined on the Township's as-built checklist and shall include the seal and signature of a Pennsylvania registered engineer or land surveyor. No further inspections shall be scheduled or conducted until an as-built site plan has been submitted, reviewed and approved by an authorized Township representative. Exception: The as-built requirement shall not apply to additions, alterations, repairs and maintenance of existing buildings and structures."
F . 
Section 107.6.3, Erosion and Sedimentation Control Plan, is hereby added to the Building Code of the Township to read as follows:
Section 107.6.3. Erosion and Sedimentation Control Plan. An erosion and sedimentation control plan shall be submitted with all applications wherein excavation, placement of fill and/or grading activities are proposed. The plan shall include a construction staging narrative indicating the sequence of earthmoving activities and proposed erosion and sedimentation control procedures. Measures used to control erosion and reduce sedimentation during construction shall conform to the standards and specifications of the Bucks County Conservation District. At a minimum, the following measures shall be included where applicable:
(1) 
Stripping of vegetation, regrading or other activities shall be completed in a way that will minimize erosion and resulting sedimentation.
(2) 
Cut and fill operations shall be kept to a minimum. Wherever feasible, natural vegetation shall be retained, protected and supplemented.
(3) 
All erosion and sedimentation control measures shall be installed per the approved plan prior to any earthmoving activities.
(4) 
The disturbed earthen area and the duration of exposure shall be kept to a practical minimum, but shall not exceed 20 days. All disturbed soils and topsoil stockpile areas shall be stabilized as quickly as possible and, if necessary, seeded with temporary vegetation and mulched. If stockpile areas are located on sloping ground or near waters of the Commonwealth, same shall be enclosed with silt fencing.
(5) 
Permanent vegetation shall be installed as soon as practical on all sites.
(6) 
All runoff from project areas shall be collected and diverted to facilities for removal of sediment.
(7) 
Runoff from a project area shall not be discharged into the waters of the commonwealth without means to prevent sedimentation.
(8) 
Sedimentation in the runoff water shall be trapped and filtered until the disturbed area is stabilized by the sue of debris basins, sediment basins, silt traps or similar measures.
(9) 
Sediment barriers shall be properly installed with silt fencing trenched and hay bales staked.
(10) 
Tire cleaning areas constructed of AASHTO No. 1 stone and at least 50 feet in length shall be provided at each point of access to the lot.
(11) 
During construction activities, necessary measures for dust control must be exercised.
(12) 
It shall be the responsibility of each person, corporation or other entity performing grading and/or building activities to install and maintain erosion and sedimentation controls until the site is stabilized.
G. 
Section 107.6.4, Grading Plan, is added to the Building Code of the Township to read as follows:
§ 107.6.4. Grading Plans. Applications for building permits wherein excavation, placement of fill and/or grading activities are proposed on any residential lot less than 60,000 sq. ft. in area; all commercial, industrial, and/or institutional applications; and all applications for any residential lot where, in the opinion of the Code Official, lot features such as slope, soils or other natural features require special consideration of onlot grading; shall be accompanied by a site plan providing the following information:
(1) 
A plot plan prepared by an engineer or surveyor licensed in the Commonwealth of Pennsylvania showing the proposed and existing topography of the site; all existing improvements to the site; dimensions, first floor elevations, and setbacks from property lines for all existing and proposed buildings; and location of all existing and proposed wells, water lines, utility lines, septic systems, sewer lines, storm sewers, sump pump drains, easements, trees to be removed, trees to remain, etc. The plan shall bear the imprint of the responsible licensed engineer or surveyor.
(2) 
Plot plans shall include sufficient off-site topographic information to determine the impact of any off-site stormwater runoff draining onto or through the property.
(3) 
A statement, signed and sealed by a licensed engineer, indicating that, to the best of his/her knowledge and belief, the proposed grading activities shall not significantly increase stormwater runoff to, and/or otherwise adversely impact, downstream properties except as may be part of an approved stormwater runoff collection and management plan.
H. 
Section 108.1.1, Site Plan Review, is added to the Building Code of the Township to read as follows:
Section 108.1.1. Site Plan Review. For all residential lots less than 60,000 sq. ft. in area, and all commercial, industrial, and institutional applications, the site plan shall be referred to the Township Engineer for review. For all other applications, the site plan shall be reviewed by the Code Official and/or Township Engineer and shall conform in every respect to the approved subdivision and/or land development plan for the site. If, in the opinion of the Code Official, proposed grading activities do not conform to previously approved plans, the application shall be referred to the Township Engineer for review.
I. 
Section 111.0, Conditions of Permit, of the Building Code of the Township is hereby amended to add the following subsections:
Section 111.5. First Floor Certifications. Construction of any new dwelling requiring a grading plan pursuant to § 107.64 and all nonresidential buildings may not continue past the foundation stage until the owner/builder has submitted certification that the first floor elevation of the proposed structure conforms to the site plan. The certification shall be submitted to the Township Code Official on a form approved by the Township and shall be signed and sealed by the responsible engineer or surveyor licensed in the Commonwealth of Pennsylvania.
Section 111.6. General Grading Requirements. All building construction wherein excavation, placement of fill and/or grading activities are performed shall conform to the following general requirements:
(1) 
No excavation or fill shall be made with a face steeper than three horizontal to one vertical, except under one or both of the following conditions:
(a) 
The material is sufficiently stable to sustain a steeper slope. A written statement to that effect from a civil engineer licensed in the Commonwealth of Pennsylvania and experienced in erosion control shall be submitted to the Code Official. The statement shall affirm that the site has been inspected and the deviation from the slope restriction shall not result in injury to persons or damage to property. A detail of the treatment of the slope (proposed grade, seeding, erosion protection, etc.) shall be submitted with the application.
(b) 
A concrete, masonry or other approved retaining wall constructed in accordance with approved standards is provided to support the face of the excavation or fill.
(2) 
Edges of slopes shall be a minimum of five feet from property lines or right-of-way lines of streets in order to permit the normal rounding of the edge without encroachment on abutting property.
(3) 
Adequate provision shall be made to prevent surface water from damaging the cut face of excavation and the sloping surfaces of fills.
(4) 
No person, corporation or other such entity shall block, impede the flow of, alter, construct any structure or deposit any material or thing or perform any work that will affect the normal or flood flow in any stream or watercourse without having obtained prior approval from the Township and/or Department of Environmental Protection, whichever is applicable.
(5) 
All lots, tracts or parcels shall be graded to provide positive drainage away from buildings and dispose of it without ponding, except where ponding (detention basins, swales, etc.), is part of the stormwater management plan for the site.
(6) 
Concentration of surface water runoff shall be permitted only in swales, watercourses, or detention basins.
(7) 
All plans wherein a sump pump or basement drain is proposed to be installed, shall provide for discharge of the sump pump/drain to a natural watercourse, drainage swale, stormwater easement, storm sewer system, or open space area.
(8) 
Each person, corporation, or other entity which makes any surface changes shall be required to:
(a) 
Collect on-site surface runoff and control it to a point of discharge into the natural watercourse of the drainage area, stormwater easement, or storm sewer system.
(b) 
Control existing off-site runoff draining through the property by designing it to discharge to the natural watercourse of the drainage area, stormwater easement, or storm sewer system.
(9) 
In no case shall grading be completed in such a manner as to divert water onto the property of another landowner unless part of a stormwater management plan.
(10) 
During grading operations, necessary measures for dust control must be exercised.
(11) 
No grading equipment shall be permitted to be loaded and/or unloaded on a public street, and no grading equipment shall be permitted to travel on or across a public street unless licensed for operation on public thoroughfares.
J. 
New Section 12.2.1. Special Fees, Compliance Escrow. Insert: "A compliance escrow shall be provided at time of building permit issuance and shall be refunded upon issuance of certificate of occupancy. This fee shall be determined in conjunction with the fee schedule as provided in § 112.3.1 of the Building Code. The compliance escrow shall be forfeited in its entirety for any of the following reasons:
(1) 
Occupying the structure for the intended use without first obtaining a certificate of occupancy issued by the Township.
(2) 
Failure to schedule, obtain and pass all prescribed inspections for which a building permit has been issued prior to proceeding with construction."
K. 
Section 112.3.1. Fee Schedule. Insert: "The fee schedule adopted by the Board of Supervisors under separate resolution as amended from time to time."
L. 
Section 113.8, As-Built Drawings, is added to the Building Code of the Township to read as follows:
Section 113.8. As-Built Drawings. For all applications required to prepare a site grading plan in accordance with § 107.6.4., as-built plans indicating compliance with the site plan shall be prepared by a licensed surveyor or engineer and submitted to the Township prior to issuance of a use and occupancy permit. In the event the site grading does not conform to the approved site plan, no use and occupancy of the structure constructed pursuant to the building permit shall be permitted until the final grading is approved by the Township.
M. 
New Section 115.2, Contractor Registration. Insert: "All general, plumber, sprinkler fitter, electrical and mechanical contractors shall be registered annually with the Township Administration Office, fee as set forth in § 112.3.1 shall be accessed yearly in conjunction with the registration. The minimum insurance coverage shall be as adopted by the Board of Supervisors under separate ordinance as amended from time to time."
N. 
Section 116.4. Violation Penalties. Insert: "Any person firm or corporation who shall violate any provision of this Part, upon conviction thereof in an action brought before a Magisterial District Judge in the manner provided for the enforcement of summary offenses under the Pennsylvania Rules of Criminal Procedure, shall be sentenced to pay a fine of not more than $1,000 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 90 days. Each day that a violation of this Part continues of each section of this Part which shall be found to have been violated shall constitute a separate offense."
O. 
Section 117.2. Unlawful Continuance. Insert: "[$500], [$2,000]."
P. 
Section 118.4. Certificate of Occupancy, Contents of Certificate. Delete: Specifications No. 4, 5 and 6 in their entirety.
Q. 
Section 121.2.1. Qualifications.
(1) 
Delete: "each" in the first sentence.
(2) 
Insert: "any" at the deletion of "each."
R. 
New Section 121.2.1.6 Qualifications. Insert: "Building Official or BOCA Certified Inspector with not less than 10 years of code official experience."
S. 
Section 310.6. Use Group R-4 Structures.
(1) 
Delete: The last sentence in its entirety.
(2) 
Insert at end: "All such structures shall be designed in accordance with the One- and Two-Family Dwelling Code and in accordance with the requirements of the Building, Mechanical, Plumbing and Electrical Codes as applicable to Use Group R-3. Whenever a conflict may occur within the provisions of the Codes, then the more stringent standard shall apply."
T. 
New Section 312.2. Accessory and Miscellaneous Structures. Insert:" All buildings and structures of Use Group U shall be constructed on a continuous foundation capable of supporting the structure and located below the prevailing frost line. Exception: In lieu of a continuous foundation, buildings and structures less than 121 square feet in area or 10 feet in height may construct the unit on not less than a ten-inch clean stone bed with positive mechanical anchors in each anchors. The mechanical anchors shall be of adequate design to resist the pressures caused by wind in any direction."
U. 
Section 403.1. High-Rise Buildings, Applicability.
(1) 
Delete: "75 feet (22860)" from the first sentence.
(2) 
Insert: "40 feet" at the "75 feet" deletion.
V. 
Section 407.4. Private Garages, Attached to Rooms.
(1) 
Delete: "1/2-inch gypsum board or the equivalent" from the first sentence.
(2) 
Insert: "One-hour fire resistance rated construction" at the "1/2-inch gypsum board or the equivalent" deletion.
W. 
Section 407.6. Private Garages, Opening Protectives.
(1) 
Delete the paragraph in its entirety.
(2) 
Insert: "The door opening protectives shall be not less than 3/4-hour fire door assemblies and shall bear the label of an approved agency. All fire doors shall be self-closing in accordance with the requirements of NFPA 80 listed in Chapter 35 of the Building Code and all appurtenant hardware shall be fire rated."
X. 
New Section 413.5.4. Special Amusement Buildings. Insert: "All doors within the building, structure or amusement shall be equipped with panic hardware and shall be inspected weekly by the Township Fire Marshal."
Y. 
New Section 421.10.1.9 (9.3). Enclosure for Private Swimming Pools, Spas and Hot Tubs/Outdoor. Alarm Power Source. Insert: "All alarm devices shall receive AC primary power from the building wiring and shall receive power from a battery when the AC primary power source is interrupted. Wiring shall be permanent and without a disconnecting switch other than those required for overcurrent protection."

Where buildings are equipped throughout with an approved automatic fire suppression system."
KK. 
Section 919.3.2. Smoke Detectors, Use Groups R-2 and R-3. Delete "Exception No. 1" in its entirety.
LL. 
Section 920.2. Portable Fire Extinguishers, Where Required.
(1) 
Delete section in its entirety.
(2) 
Insert: "A portable fire extinguisher shall be installed in all occupancies in accordance with NFPA 10 listed in Chapter 35. Exception: Portable fire extinguishers shall not be required in use groups R-3 and R-4 occupancies."
MM. 
Section 923.2. Supervision, Fire Protective Signaling Systems. Insert: "Where fire protective signaling systems do not transmit alarm and trouble signals to an approved central-station system, approved signs shall be installed directly above each pull station stating, 'fire alarm does not call fire department - if alarm is sounding call 9-1-1 immediately" at end of first paragraph.
NN. 
Section 1010.4. Emergency Escape. Insert: "The required opening sizes shall be obtained by the normal operation of the window from the inside" as the last sentence of the first paragraph.
OO. 
Section 1021.3. Guards, Opening Limitations. Insert at end: "Guards shall have all intermediate members installed in a vertical pattern."
PP. 
Section 1023.1. Exit Signs and Lights, Location.
(1) 
Delete the first sentence in its entirety.

Insert: "All buildings shall be equipped throughout with approved signs reading 'exit' indicating all required means of egress from each building, room and space, and where necessary supplemental directional signs shall be installed indicating the direction and way of egress" as the first sentence.

New Section 1905.2. Concrete Slab Thickness. Insert: "All concrete slabs placed on more than eight inches of fill shall have either a certificate of compaction sealed and signed by a Pennsylvania-registered engineer or the slab shall be reinforced so as to be self supporting and capable of carrying the anticipated live loads, whether uniformly distributed or concentrated. The self-supporting slab design shall be submitted for Township review with the seal and signature of a Pennsylvania-registered engineer."

This Plumbing Code shall be for the control of buildings and structures as herein provided, and each and all of the regulations, provisions, penalties, conditions and terms of said BOCA National Plumbing Code, are hereby referred to, adopted and made a part hereof as if fully set out in this Part with the additions, insertions, deletions and changes prescribed in § 5-110 of this Part.

That a certain document three copies of which are on file in the Administration Office of the Township of Plumstead being marked and designated as the "NFPA 70 National Electrical Code, 1996 Edition" as published by the National Fire Protection Association is hereby adopted as the Electrical Code of the Township. This Electrical Code shall be for the control of buildings and structures as herein provided, and each and all of the regulations, provisions, penalties, conditions and terms of said NFPA National Electrical Code, is hereby referred to, adopted and made a part hereof as if fully set out in this Part with the additions, insertions, deletions and changes prescribed in § 5-112 of this Part.

That a certain document, three copies of which are on file in the Administration Office of the Township of Plumstead being marked and designated as the "CABO One- and Two-Family Dwelling Code, 1992 Edition" as published by the Council of American Building Officials is hereby adopted as the One- and Two-Family Dwelling Code of the Township. This One- and Two-Family Dwelling Code shall be a supplement to the other codes adopted under this Part and shall be for the control of buildings and structures as herein provided; and each and all of the regulations, provisions, penalties, conditions and terms of said CABO One- and Two-Family Dwelling Code, are hereby referred to, adopted and made a part hereof as if fully set out in this Part with the additions, insertions, deletions and changes prescribed in § 5-114 of this Part. The One- and Two-Family Dwelling Code does not repeal, abrogate, annul or in any way impair of interfere with the provisions of the other codes adopted within this Part. Whenever a conflict may occur within the provisions of the codes, then the more stringent standard shall apply.

That nothing in this Part, Building Code, Fire Prevention Code, Mechanical Code, Plumbing Code, Electrical or One- and Two-Family Dwelling Code hereby adopted shall be construed to affect any suit or proceeding impending in any court, or any rights acquired, or liability incurred or any causes of action acquired or existing, under any act or ordinance hereby repealed in this Part. Nor shall any just or legal right or remedy of any character be lost, impaired or affected by this Part.

It is hereby declared to be the intent of the Board of Supervisors that:
1. 
If a court of competent jurisdiction declares any provisions of this Part to be invalid or ineffective in whole or in part, the effect of such decision shall be limited to those provisions which are expressly stated in the decision to be invalid or ineffective, and all other provisions of this Part shall continue to be separately and fully effective.
2. 
If a court of competent jurisdiction finds the application of any provision of this Part to any lot, building or other structure, or tract of land, to be invalid or ineffective in whole or in part, the effect of such decision shall be limited to the person, property or situation immediately involved in the controversy, and the application of any such provision to other persons, property or situations shall not be affected.

The Board of Supervisors may, from time to time, amend, supplement, change, modify or repeal the codes adopted under this Part. When undertaking such actions, the Board of Supervisors shall proceed in the manner prescribed in the Commonwealth of Pennsylvania's Second Class Township Code, as amended.[1]

All existing building, fire prevention, mechanical, plumbing, electrical and one- and two-family dwelling codes adopted under previous ordinances plus all supplements and amendments thereto are hereby repealed; provided, however, if the present Part is held to be ineffective or invalid by reason of some irregularity in or impediment to its passage, this repealer shall also be ineffective as aforesaid. Then and in that event, all existing building, fire prevention, mechanical, plumbing, electrical and one- and two-family dwelling codes, plus all supplements and amendments, would necessarily remain in full force and effect.
