The purpose of this chapter is to promote recycling, composting,
and resource recovery through the administration of an effective recycling
program, as provided in W.S.A., § 159.11, and Chapter NR
544, Wis. Adm. Code. The City also provides through this chapter a
reliable, weekly, day-certain solid waste collection system.

The following words, terms and phrases, when used in this chapter,
shall have the meanings ascribed to them in this section, except where
the context clearly indicates a different meaning:
COMMERCIAL CLASS
All business enterprises, offices, manufacturing, sales,
industry and multifamily dwellings of five or more units.
CONTAINER BOARD
Corrugated paperboard used in the manufacture of shipping
containers and related products.
DUMPSTER
A metal container commonly used to collect refuse in multifamily
dwellings and commercial establishments.
FOAM POLYSTYRENE PACKAGING
Packaging made primarily from foam polystyrene that satisfies
one of the following criteria:
(1)
Is designed for serving food or beverages.
(2)
Consists of loose particles intended to fill space and cushion
the packaged article in a shipping container.
(3)
Consists of rigid materials shaped to hold and cushion the packaged
article in a shipping container.
GARBAGE
All kinds of organic refuse resulting from the preparation
of food and all decayed or spoiled food products from any source whatever.
GLASS
Glass bottles, jars and containers and does not include window
glass, drinking glasses, Pyrex, light bulbs or other noncontainer
glass.
HAULER
The refuse (solid waste) service contracted with by the City
or contracted for directly by residential or commercial customers,
which collects and removes from the City all refuse to a properly
licensed landfill or incinerator. All such haulers must abide by preparation
standards for recyclable materials. No hauler shall remove refuse
which does not comply with the requirements of this chapter.
HDPE
High-density polyethylene, labeled by the SPI Code No. 2.
LEAD ACID BATTERIES
Automotive and related batteries that are comprised of lead
plates with an acid electrolyte and does not include nickel cadmium
batteries, dry cell batteries or batteries used in calculators, watches,
hearing aids or similar devices.
LDPE
Low-density polyethylene, labeled by the SPI Code No. 4.
MAGAZINES
Magazines and other materials printed on similar paper.
MAJOR APPLIANCES
A residential or commercial air conditioner, clothes dryer,
clothes washer, dishwasher, freezer, microwave oven, oven, refrigerator,
stove, water heater, furnaces, boilers, dehumidifiers or any other
items commonly referred to as "white goods."
METAL CANS
Any tin-coated steel cans, bimetal cans and aluminum cans
used for food and other nonhazardous materials, but excluding aerosol
cans and cans that held paint, paint-related products, pesticides
or other toxic or hazardous substances.
MULTIPLE-FAMILY DWELLINGS
A property containing five or more residential units, including
those which are occupied seasonally.
NEWSPAPER OR NEWSPRINT
A common and inexpensive machine finished paper made chiefly
from wood pulp and used mostly for newspapers. All newsprint shall
be recycled.
OFFICE PAPER
High-grade printing and writing papers from offices in nonresidential
facilities and properties. Printed white ledger and computer printout
are examples of office paper generally accepted as high grade. This
term does not include industrial process waste.
PETE
Polyethylene terephthalate, labeled by the SPI Code No. 1.
PLASTIC CONTAINER
An individual, separate, rigid plastic bottle, can, jar or
carton, except for a blister pack, that is originally used to contain
a product that is the subject of a retail sale.
POSTCONSUMER WASTE
Solid waste other than solid waste generated in the production
of goods, hazardous waste, as defined in W.S.A., § 144.61(5),
waste from construction and demolition of structures, scrap automobiles,
or high-volume industrial waste, as defined in W.S.A., § 144.44(7)(a)1.
PP
Polypropylene, labeled by the SPI Code No. 5.
PS
Polystyrene, labeled by the SPI Code No. 6.
PVC
Polyvinyl chloride, labeled by SPI Code No. 3.
RECYCLABLE MATERIALS
All identified materials meeting preparation standards and
shall include the following: tin; aluminum; major appliances; newsprint;
cardboard; office paper, waste oil; unbroken brown, green and clear
container glass; rigid plastic containers, including those made of
PETE, HDPE PVC, LDPE, PP, and PS and other resins or multiple resins;
waste tires; lead acid batteries; other metals; and any other material
recognized by the state as recyclable. Such materials shall be recycled
in accordance with W.S.A., § 159.07 et seq., and this Code.
REFUSE
All nonrecyclable inorganic matter, such as garbage, furniture,
china, crockery, cloth, wood, ashes and other items of a similar nature.
It does not include leaves, grass, trees, tree limbs, earth, stone,
manure or material obtained from demolishing or remodeling of buildings
and other property whenever such materials exceeds one container per
collection in quantity.
REGULAR COMMERCIAL COLLECTION
The collection of refuse from multiple-family residences
of five dwelling units or more or from commercial establishments as
stored in City-approved dumpsters placed in an approved location for
service on a once-a-week basis. Commercial class customers shall contract
separately with any refuse hauler for service.
REGULAR RESIDENTIAL COLLECTION
The collection of combined refuse from one-, two-, three-,
and four-family dwelling units in approved containers on a once-a-week
basis. Each single-family dwelling unit shall be limited to four garbage
cans for municipal collection without additional charges.
RESIDENTIAL CLASS
All dwelling units and multifamily buildings of less than
five units.
SOLID WASTE TREATMENT
Any method, technique or process which is designed to change
the physical, chemical or biological character or composition of solid
waste. The term "treatment" includes incineration.
UNUSUAL, HEAVY, BULKY OR HAZARDOUS ITEMS
Items which cannot fit into a standard thirty-two gallon
garbage container or which exceeds four feet in length or 70 pounds
or which contains hazardous waste. Items exceeding this standard may
be picked up at the discretion of the contract hauler. This definition
does not include white goods, i.e., stoves, water heaters or appliances.
All such materials must be placed at the curbside for pickup.
WASTE TIRE
A tire that is no longer suitable for its original purpose
because of wear, damage or defect.
YARD WASTE
Leaves, grass clippings, yard and garden debris and brush,
including clean woody vegetative material no greater than six inches
in diameter. This term does not include stumps, roots or shrubs with
intact root balls.

It is not intended by this chapter to repeal, abrogate, annul,
impair or interfere with any existing rules, regulations, ordinances
or permits previously adopted or issued pursuant to law. However,
whenever this chapter imposes greater restrictions, the provisions
of this chapter shall apply.

In their interpretation and application, the provisions of this
chapter shall be held to be the minimum requirements and shall not
be deemed a limitation or repeal of any other power granted by the
state statutes. Where any terms or requirements of this chapter may
be inconsistent or conflicting, the more restrictive requirements
or interpretation shall apply. Where a provision of this chapter is
required by state statutes, or by a standard in Chapter NR 544, Wis.
Adm. Code, and where the ordinance provision is unclear, the provision
shall be interpreted in light of the state statutes and the Chapter
NR 544 standards in effect on the date of the adoption of the ordinance
from which this chapter is derived (January 1, 1995), or in effect
on the date of the most recent text amendment to this chapter.

The requirements of this chapter apply to all persons within
the City.

Except as otherwise provided in this chapter, any person found in violation of any provision of this chapter or any order, rule or regulation made under this chapter shall be subject to a penalty as provided in Section
1-12.

(a) Enforcement. The City Business Administrator or the supervising department
and all police officers shall give attention throughout the City to
any case of violation of this chapter, promptly report the same and
take action to correct the violation.
(b) Administration. The provisions of this chapter shall be administered
by City Business Administrator.

Supervision of garbage collection services shall be through
the City Business Administrator and the City department he designates,
subject to the provisions of this chapter and such additional rules
and regulations as may be made from time to time by the City Council.

No person shall deposit, throw, scatter or place any garbage
or other refuse on or within any public street, alley, park, sidewalk
or other public place or within any private property or premises,
whether owned, kept or controlled by such person or not, except in
the manner provided in this chapter or as directed by the police department
for the health, safety and welfare of the City.

Commercial establishments and apartment or multiple-family facilities
of five units or more shall contract directly with haulers for recycling
and solid waste collection and disposal services at the expense of
such establishments.

The provisions of the ordinance from which this chapter is derived
took effect on January 1, 1995.
