[Code 1992, § 18.04(1)]
It is recommended that the subdivider, prior to preparation
of plans and other documents required for an application for approval
of a preliminary plat, consult with the plan commission and other
city officials relative to requirements of the master plan, city zoning
ordinance, this chapter and other applicable codes and ordinances
of the city. Request for such consultation does not require filing
an application and payment of a fee, but it is suggested that the
subdivider have a preliminary sketch plan of the proposed subdivision.

Any person contemplating the subdivision of land within the
city or its extraterritorial plat approval jurisdiction before submitting
a final plat for approval shall file with the city clerk at least
10 days prior to a regular meeting of the plan commission, legible
prints of a preliminary plat conforming to the master plan, regulations
contained in this chapter governing preliminary plats and other applicable
codes and ordinances of the city. The subdivider shall provide 11
such prints at his expense.

The submission of the prints of the preliminary plat shall constitute
official filing, and the city clerk shall note on each print the date
filed and shall immediately forward copies to the following:
(1) Two copies for each of the state agencies required to review the
plat to the department of development.
(2) One copy for the official file.
(3) Two copies for the plan commission.
(4) Two copies to the city engineer.

(a) The plan commission shall, within 90 days of the submission of the
preliminary plat, review the plat and negotiate with the subdivider
on changes deemed advisable, approve, approve conditionally or reject
such plat. The subdivider shall be notified in writing of any conditions
of approval or the reasons for rejections. Pursuant to W.S.A., ch.
236, no approval shall be granted until it has been certified that
there is no objection to the plat by any agency authorized to object.
(b) Upon such approval by the plan commission, two copies of the approved
preliminary plat shall be signed by the chairman of the plan commission.
Both copies shall be transmitted to the city clerk, one for the official
file; the other to be transmitted to the subdivider.
NOTICE OF APPROVAL OF PRELIMINARY PLAT

Notice is hereby given that the preliminary plat of the subdivision
shown hereon has received approval by the plan commission of the City
of Lake Geneva, Wisconsin, and upon compliance by the subdivider with
requirements of qualifications governing approval of preliminary plats
and with other revisions and stipulations that may be required, the
city council will receive the application for final plat approval
for all or a part of such approved preliminary plat, when submitted
by the subdivider in such form and within such time as required by
this ordinance.

The preliminary plat shall show the following:
(1) Identification and description. The identification and description
shall indicate the following:
a. Proposed name of subdivision, not duplicating the name of any plat
heretofore recorded in the city or the county.
b. Location by section, town and range or by other legal description.
c. An accompanying boundary line survey map with accurate distances
and angles prepared and certified by a registered surveyor and an
accompanying topographic map indicating source of survey shall accompany
the preliminary plat.
d. Names and addresses of the owner and subdivider having control of
tract and designer of the plat.
e. Graphic (engineering) scale shall not exceed 100 feet to one inch.
f. North point (designated as true north).
(2) Existing conditions. Existing conditions shall be indicated as follows:
a. Boundary line of proposed subdivision in accordance with subsection
(1)c. of this section.
c. Existing zoning districts in proposed subdivision and adjoining areas.
d. Location, widths and names of all existing or previously platted
streets or other rights-of-way designating type of improvements, railroad
and utility rights-of-way, parks and other public open spaces, easements,
section lines, and corporation lines within the tract and to a distance
of at least 300 feet beyond the boundaries of the subdivision.
e. Location and size of existing sewers, water mains, culverts, or other
underground facilities and permanent buildings and other structures,
within the subdivision and to a distance of 100 feet beyond its boundaries;
also indicating locations and invert elevations of manholes and catchbasins,
and location of fire hydrants. Elevations shall be based upon the
city datum or upon an established elevation acceptable to the city
engineer and the benchmark used in determining the elevations shall
be noted.
f. Location map drawn at a scale of not less than one inch equals 1,000
feet, indicating boundary lines of adjoining unsubdivided or subdivided
land within an area bounded by nearest thoroughfares or other natural
boundaries, type of use and ownership of adjoining land and alignments
of existing streets.
g. Topographic data in accordance with subsection (1)c of this section,
including existing contours at vertical intervals of not more than
two feet, except in unusual topographical conditions such vertical
intervals may be required to be altered as determined by the city
engineer. Topographic data shall refer to the city datum or upon an
established elevation acceptable to the city engineer, and the benchmark
used in determining the elevations shall be noted. Location of watercourses,
marshes and other significant features shall be shown. Soil boring
data seepage tests may be required at locations and depths as determined
by the city engineer.
h. Locations of or reference to locations of existing monuments or survey
markers used in preparation of survey and grade elevation of such
monument and markers.
(3) Subdivision design features. The subdivision design features shall
be indicated as follows:
a. The design of the preliminary plat shall be in substantial accord
with the master plan.
b. Layout of streets showing street widths and names (not duplicating
the name of any street already used in the city or its environs, unless
the street is an extension of or in line with an already named street,
when that name shall be used). Proposed collector streets shall be
designated and through streets shall be extended to boundaries of
the subdivision.
c. Location and width of alleys, pedestrian ways, utility easements
and no access strips.
d. Layout, numbers and typical dimensions of blocks and lots, scaled
to the nearest foot.
e. Minimum front and side street building setback lines, indicating
dimensions.
f. Areas (other than those listed in subsection (3)b, (3)c and (3)d
of this section), if any, intended to be dedicated or reserved for
public or semipublic uses, indicating in each the approximate acreage,
designated by letter or number.
g. Source of domestic water supply and types and directions of flow
of sanitary sewage and stormwater drainage systems.

(a) Changes or revisions in the subdivision design features of an approved
preliminary plat may be required by the plan commission when necessary
in the interest and needs of the community in keeping with the provisions
of this chapter and in consideration of conditions unforeseen at the
time of approval of the preliminary plat.
(b) No land will be approved for subdivision which is subject to periodic
flooding or which contains inadequate drainage facilities, unless
the resultant divisions become unified parts of contiguous lots or
parcels. However, if the subdivider agrees to make improvements which
will, in the opinion of the city engineer, make such land completely
safe for improvement and occupancy and provide adequate drainage,
the preliminary plat for subdivision may be approved. Such approval
will be based upon scientific engineering data prepared by a registered
engineer and submitted by the subdivider.
(c) Subsequent to the approval of the preliminary plat and prior to filing
an application for final plat approval, the subdivider shall have
the city engineer review the plans and specifications for all sanitary
sewer, storm sewer, water main improvements and all other land improvements.
All plans and specifications are to be reviewed by the city engineer
and other public officials having jurisdiction over such approvals.

A fee of $1 per lot, with a minimum fee of $25 and a maximum
fee of $100, shall be paid by the subdivider to the city at the time
of filing the preliminary plat with the city council at the office
of the city clerk.
