An annual levy not to exceed $0.02 per $100 shall be assessed
against all real property within the Township of Liberty.
A separate account will be created to be known as the Liberty
Township "Open Space, Recreation and Farmland and Historic Preservation
Trust Fund" for deposit of revenues to be expended for each of the
purposes specified in the proposition, namely:
A. Acquiring land for preservation as open space.
B. To provide for outdoor recreation.
D. To assist in the acquisition of the same.
Any interest or income earned on monies deposited in the Liberty
Township Open Space, Recreation and Farmland and Historic Preservation
Trust Fund shall be credited to the fund to be used for the same purposes
as the principal.
Separate funds may be created for each purpose.
This chapter may be amended as provided by N.J.S.A. 40:12-15.7(d)
or pursuant to N.J.S.A. 40:12-15.7(e) upon petition to the governing
body signed by voters of the Township of Liberty equal to at least
15% of the votes cast therein in the last preceding general election,
to be filed with the governing body at least 90 days before a general
or special election.
All decisions concerning the purchase and management of real
estate or an interest therein shall be solely the responsibility of
the Township Committee. The Township Committee may, at its discretion,
appoint an advisory panel to assist them in making these decisions.
However, all decisions relative to the Open Space, Recreation Farmland
and Historic Preservation Trust Fund shall be solely that of the Township
Committee.
The Township Committee shall have all the rights and powers
granted by N.J.S.A. 40:12-15.9, as it exists today and as it may be
amended, to deal with lands acquired and held in trust and dealing
with the use, conveyance and deposits of any proceeds of any conveyance.
